Book excerpt: Sovereignty, Knowledge, Law investigates the notion of sovereignty from three different, but related perspectives: as a legal question in relation to the sovereign state, as a political question in relation to sovereign power, and as a metaphysical question in relation to sovereign self-knowledge. The varied and interchangeable uses of legal sovereignty, political sovereignty and metaphysical sovereignty in contemporary debates have resulted in a situation where the word ‘sovereignty’ itself has become something of a non-concept. Panu Minkkinen shows here how these three perspectives have informed one another, by addressing their shared relationship to law, and to the ‘autocephalous’ function of sovereignty; that is, the attempt to provide a single source and foundation for law, power, and self-knowledge. Through an effort to domesticate the intrinsically ‘heterocephalous’ nature of power, the juridical and jurisprudential aim has been to confine power within the closed vertical hierarchy of traditional legal thinking. Sovereignty, Knowledge, Law thus elaborates this heterocephaly, proposing new understandings of sovereignty, as well as of law and of legal scholarship.

Il a comme fonction la limitation des obligations substantielles des États lors de la survenance d’un fait-condition – la situation de nécessité – afin d’éviter que l’application du droit ne génère un coût social excessif. Sa réalisation requiert toujours une pondération des intérêts en conflit. Seulement lorsqu’un coût social excessif ne peut être évité, l’état de nécessité intervient dans le cadre des obligations secondaires de la responsabilité internationale, en tant que circonstance atténuante. After much hesitation, the International Law Commission codified the state of necessity as a circumstance precluding wrongfulness in the field of State responsibility. This study aims to demonstrate that it is a much wider mechanism, essential to international law and strictly connected to its own characteristics. It performs the function of limiting the substantial obligations of States in case of the realization of a fact condition – a situation of necessity – in order to avert an excessive social cost, born out of law implementation. It always works through a balance of conflicting interests. Only when a social cost cannot be avoided, the state of necessity, under the features of a mitigating circumstance, enters the field of secondary obligations relating to international responsibility.

Book excerpt: The notion of the First World War as 'the great seminal catastrophe' (Urkatastrophe) of the twentieth century is now firmly established in historiography. Yet astonishingly little has been written about the fate of non-combatants in occupied and non-occupied territory, including civilian internees, deportees, expellees and disarmed military prisoners. This volume brings together experts from across Europe to consider the phenomena of captivity, forced labour and forced migration during and immediately after the years 1914 to 1918. Each contribution offers a European-wide perspective, thus moving beyond interpretations based on narrow national frameworks or on one of the fighting fronts alone. Particular emphasis is placed on the way in which the experience of internees, forced labourers and expellees was mediated by specific situational factors and by the development of ‘war cultures’ and ‘mentalities’ at different stages in the respective war efforts. Other themes considered include the recruitment and deployment of colonial troops in Europe, and efforts to investigate, monitor and prosecute alleged war crimes in relation to the mistreatment of civilians and POWs. The final contribution will then consider the problems associated with repatriation and the reintegration of returning prisoners after the war. This book was published as a special issue of Immigrants and Minorities.
