Book excerpt: In the last hundred years, the philosophy of natural law has suffered a fate that could hardly have been envisaged by the seventeenth and eighteenth century exponents of its universality and eternity: it has become old-fashioned. The positivists and the Marxists were happy to throw eternal moral ity out of the window, confident that some magic temporal harmony would eventually follow Progress in by the front door. Their hopes may not have been fully realized, but they did succeed in discrediting natural law. What is often not appreciated is the extent to which we have adopted the tenets of the philosophy they despised, borh in the field of politics, and in the field of personal and social ethics, which Barbeyrac called "la science des mreurs" and which the positivists re christened "social science". Consequently, though we live in a world whose freedom, such as it is, is largely a result of the popularization of the philosophy of natural law, and whose conscious and unconscious standards, such as they are, are a result of that philosophy as it became combined with Christianity, the doctrine of natural law is itself for gotten. In view of the oblivion into which it has fallen, natural law is a concept which means little to the average reader. All too often, Montesquieu scholars have traded on this oblivion in order to give an exaggerated picture of his originality.

Book excerpt: One of the great paradoxes of post-medieval Europe, is why instead of bringing peace to a disorganised and violent world, modernity instead produced a seemingly endless string of conflicts and social upheavals. Why was it that the foundation and institutionalisation of secured peace and the rule of law seemed to go hand-in-hand with the proliferation of war and the violation of individual and collective rights? In order to try to better understand such profound questions, this volume explores the history and theories of political thought of international relations in the seventeenth century, a period in which many of the defining features and boundaries of modern Europe where fixed and codified. With the discovery of the New World, and the fundamental impact of the Reformation, the complexity of international relations increased considerably. Reactions to these upheavals resulted in a range of responses intended to address the contradictions and conflicts of the anarchical society of states. Alongside the emergence of "modern" international law, the equation of international relations with the state of nature, and the development of the "balance of power", diplomatic procedures and commercial customs arose which shaped the emerging (and current) international system of states. Employing a multidisciplinary approach to address these issues, this volume brings together political scientists, philosophers, historians of political thought, jurists and scholars of international relations. What emerges is a certain tension between the different strands of research which allows for a fruitful new synthesis. Book excerpt: I t is only relatively recently that serious attempts have been made to rescue Diderot's political writings from obscurity and neglect, and ascribe to the ideas expressed therein their due place in the panoply of his intellectual and artistic achievements. This has been largely made possible by the transference of the Fonds Vandeul from Diderot's descendants to the Bibliotheque Nationale in 1954. This important collection of manuscripts and papers, to which scholars have previously had very inadequate access, contains the bulk of the political writings, most of which had either never been published, or were only obtainable in badly prepared or rare editions. In recent years, however, excellent critical editions of the most impor tant political texts have appeared; the Textes Politiques edited by Yves Benot, and the Oeuvres Politiques and the Memoires pour Catherine II edited by Paul Verniere are all notable contributions. Meanwhile Jacques Proust has written a major thesis on Diderot et l'Encyclopedie which con tains a detailed study of Diderot's political ideas during the years he de voted to the construction of that great intellectual monument. Most re cently Yves Benot has published a general work with an important study of Diderot's hostility to European colonial policies, Diderot, de l'atheisme a l'anticolonialisme. Furthermore, Diderot's contributions to the three editions of Raynal's Histoire des deux Indes have been identified with virtual certainty by Michele Duchet and Hans Wolpe, thereby opening up a further valuable source for his political ideas.
