Enfin, le droit administratif est susceptible de réglementer les rapports qu'entretient le footballeur avec la fédération Française de football qui détient une délégation de service public. Il résulte de toutes ces influences une spécificité. Celle-ci se caractérise par l'existence d'un environnement particulier dans lequel évolue avec le footballeur avec plusieurs fédérations sportives qui édictent des normes sportives ou la possibilité de saisir le tribunal arbitral du sport. Le contrat de travail du footballeur professionnel se démarque du droit commun du CDD. En effet, ce contrat de travail doit faire l'objet d'une homologation à la ligue de football professionnel. En matière de responsabilité, les juges imposent la commission d'une faute caractérisée par la violation des règles du jeu. Il sera démontré que si le contrat de travail du footballeur professionnel pris dans son ensemble n'est pas spécifique, des points précis lors de sa conclusion, son exécution ou de sa rupture démontre effectivement que ce contrat est spécifique. Nous parlerons d'une spécificité à géométrie variable du contrat de travail du footballeur professionnel.

Un transfert de joueur peut toutefois se définir comme une opération par laquelle un club accepte de mettre fin au contrat de travail à durée déterminée qui le lie à un de ses joueurs avant son terme, afin de lui permettre de s'engager auprès d'un nouvel employeur, en contrepartie du versement par ce dernier d'une indemnité financière appelée indemnité de transfert. Cette opération conciliant logiques sportive et marchande devint vite indispensable. Pourtant il ne fut pas facile de l'encadrer juridiquement. Cela se produisit néanmoins après un face-à-face d'une vingtaine d'années : il opposa principalement les institutions sportives, qui désiraient conserver leurs privilèges, et les puissances publiques nationales et européennes, attachées principalement à ce que le sport professionnel respecte les lois nationales et les grands principes de liberté de circulation des travailleurs. Ces deux partenaires, qui contribuèrent à la création d'un Tribunal arbitral du sport à vocation universelle, échouèrent à juguler une inflation inquiétante des salaires des joueurs et des indemnités qui leur sont versées à l'occasion des transferts. Le contentieux s'est également développé depuis la mise en place des organes décisionnaires de la FIFA, à savoir la Commission du statut du joueur (CSJ) et la Chambre de résolution des litiges (CRL).
