Dans un Etat de droit, I'administration est soumise au droit et au contrôle des tribunaux comme tout particulier et tout citoyen, en vertu du principe de la prééminence du droit. Compte tenu des traditions juridiques variées des Etats membres du Conseil de I'Europe dans le domaine du contentieux administratif, cette recommandation fixe des règles générales à respecter dans l'organisation du contrôle juridictionnel des actes de I'administration. Son objectif principal est d'assurer I'accès effectif au contrôle juridictionnel et de contribuer ainsi à la consolidation de I'Etat de droit et des droits de l'homme en Europe. Elle énonce cinq groupes de principes qui devraient être appliqués par les gouvernements des Etats membres et qui ont trait à la portée du contrôle juridictionnel, à I'accès à ce contrôle, au caractère indépendant et impartial des tribunaux, au droit à un procès équitable et à I'effectivité du contrôle juridictionnel.

On met alors l'accent sur la "raison d'être" de l'acte administratif, sous ses deux aspects: sous celui de la rationalité, on prend en considération la logique juridique qui oriente l'administration dans son action. Sous celui du caractère raisonnable que doit revêtir le pouvoir d'appréciation de l'administration, on examine la raison éthique qui guide l'auteur de l'acte lors de l'élaboration de celui-ci. Afin de révéler les principes directeurs de la politique jurisprudentielle quant à l'évolution du contrôle des motifs de l'acte administratif, on a voulu préciser l'intensité et le mode d'évolution de ce contrôle. L'analyse menée autour de la dichotomie entre qualification juridique et appréciation concrète des faits prouve que le degré de précision de la norme applicable détermine l'intensité de ce contrôle la nature du principe générateur de cette norme module l'approfondissement de ce contrôle. Une orientation sociocentrique de la jurisprudence qui se traduit par l'attachement du juge des faits aux valeurs dominantes de la société, tend à soumettre l'action administrative au respect de l'efficacité juridique. Le juge vise également à imposer la règle de l'appréciation raisonnable en obligeant l'administration à agir de façon acceptable par l'éthique sociale.

Since the establishment of the African Union in 2001, there has been a proliferation of regional institutions that are relevant to human rights in Africa. These include the Pan African Parliament, the Peace and Security Council, the Economic, Social and Cultural Council and the African Peer Review Mechanism of the New Partnership for Africa's Development. This book discusses the links between these institutions. It further examines the case law stemming from Africa' most important human rights instrument, the African Charter on Human and Peoples Rights, which entered into force on 21 October 1986. This new edition contains a new chapter on the African Children's Rights Committee as well as full coverage of new developments and instruments, such as the Convention on the Rights of Persons with Disabilities, the Convention on Enforced Disappearances, and the African Charter on Democracy, Elections and Governance. In criminal matters, when a decision is taken to go beyond the discretionary exchange of information towards institutionalized police co-operation, a whole Pandora'sbox of issues and problems is opened. This book, based on interviews in a wide variety of documentary sources, examines the progress of this co-operation. The authors cover all the major and theoretical issues associated with the emerging pattern of co-operation, including the harmonization ofcriminal law and criminal procedure, law enforcement strategies, police organization and discipline, and the politics of immigration and civil liberties. In a European Union without internal border controls there is widespread agreement on the objective of closer police co-operation. But prospects in some areas are not good and there are potential pitfalls, even dangers, along the road to more integrated arrangements. The authors conclude by makingrecommendations that proper accountability arrangements are a prerequisite of a balanced and efficient system of European police co-operation.

Book excerpt: In recent decades, archaeological research in north-west Europe has developed a keen interest in the total landscape that was inhabited and used by man in ancient times. The present study of palaeo-landscapes constitutes an important contribution to the reconstruction of the morphology of protohistoric and Roman landscapes. By means of combined geo-archaeological methods and computer technology researchers from Ghent University have tried to understand the structure of pre-medieval landscape of northwestern Gaul. Intensive use of remote sensing techniques and the application of a Geographic Information System, combined with more traditional fieldwork and analysis, open the way to a new approach of man's delineated environment during the early formation stage of the European landscape. Although the authors have tested this new approach only in a restricted region of the Roman Empire, it can easily be applied in most other parts of the Classical World. As such this well-illustrated book not only presents a detailed account of innovative investigations on early landscape structures in parts of modern France, Belgium and the Netherlands, it also procures a concise methodological contribution to early historical landscape research in general.
