  • Author : James G. Dwyer
  • Publisher : University of Chicago Press
  • Release : 2019-04-15

Download or read book Homeschooling written by James G. Dwyer and published by University of Chicago Press. This book was released on 2019-04-15 with total page 251 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Homeschooling: The History and Philosophy of a Controversial Practice, James G. Dwyer and Shawn F. Peters examine homeschooling’s history, its methods, and the fundamental questions at the root of the heated debate over whether and how the state should oversee and regulate it. The authors trace the evolution of homeschooling and the law relating to it from before America’s founding to the present day. In the process they analyze the many arguments made for and against it, and set them in the context of larger questions about school and education. They then tackle the question of regulation, and they do so within a rigorous moral framework, one that is constructed from a clear-eyed assessment of what rights and duties children, parents, and the state each possess. Viewing the question through that lens allows Dwyer and Peters to even-handedly evaluate the competing arguments and ultimately generate policy prescriptions. Homeschooling is the definitive study of a vexed question, one that ultimately affects all citizens, regardless of their educational background.

Major recent case law developments included in this revised edition consist of decisions from the Supreme Court addressing personal jurisdiction (Goodyear Dunlop Tires Operations, S.A. v. Brown, 131 S. Ct. 2846 (2011), J. McIntyre Machinery, Ltd. v. Nicastro, 131 S. Ct. 2780 (2011), and Daimler AG v. Bauman, 134 S. Ct. 746 (2014)), federal question jurisdiction (Gunn v. Minton, 133 S. Ct. 1059 (2013)), removal of class actions (Standard Fire Ins. Co. v. Knowles, 133 S. Ct. 1345 (2013)), change of venue and forum-selection clauses (Atl. Marine Constr. Co., Inc. v. U.S. Dist. Court for W. Dist. of Texas, 134 S. Ct. 568 (2013) [now a principal case]), class certification (Wal-Mart Stores, Inc. v. Dukes, 131 S. Ct. 2541 (2011), Comcast Corp. v. Behrend, 133 S. Italian Colors Restaurant, 133 S. Ct. 2304 (2013)), and offers of judgment (Genesis HealthCare Corp. v. Symczyk, 133 S. Ct. 1523 (2013)). Regarding the 2015 amendments to the Federal Rules of Civil Procedure, this revised edition makes reference to them in the text where appropriate. The changes include the "Duke Rules" package, which alters Rules 1, 4, 16, 26, 30, 31, 33 and 34 to make proportionality a main component of the scope of discovery, to eliminate access to subject matter discovery, require early discussions regarding preservation and privilege protection, permit early document requests, and shorten the time permitted to issue scheduling orders and to achieve service of process. The amendment to Rule 37 codifies an approach to preservation and spoliation that favors curative measures unless there is intentional spoliation, in which case more severe sanctions such as adverse inference instructions or dismissal become available. This edition also fully incorporates recent amendments to the Federal Rules of Civil Procedure and to Title 28 of the U.S. Code, including the Federal Courts Jurisdiction and Venue Clarification Act of 2011 and the 2013 amendment to Rule 45 (subpoenas). Finally, the Revised Fourth Edition integrates references to online assessment tools in the Casebook Plus platform. These consist of a bank of 200 multiple-choice questions that provide comprehensive assessment of the topics covered in this book, with detailed feedback consisting of explanations for both correct and incorrect responses. This feature provides an unparalleled opportunity to engage with the material actively as the course progresses and permits students and professors to determine the extent to which the material is being learned.

Book Collaborating for Climate Resilience

Download or read book Collaborating for Climate Resilience written by Ann Goodman and published by Routledge. This book was released on 2021-09-30 with total page 103 pages. Available in PDF, EPUB and Kindle. Book excerpt: Supporters of environmental well-being and climate resilience are awakening and mobilizing – cities, states, business, academia, community-based organizations, and the military. They understand the imminent and long-term risks of climate deterioration and they are creating new structures beyond the top-down government policy efforts of the past. This highly practical book provides a clear insight into these collaborative solutions by real organizations in real time. It demonstrates how people from disparate fields and stakeholders cooperate to address climate issues at ground level and reveals how this can be undertaken effectively. Through case studies of key organizations such as the NYC Sustainability Office, Detroiters Working for Environmental Justice, IBM, and West Point Military Academy, readers will understand each party’s role in a cooperative enterprise and the means by which they support climate resiliency, their institutional goals, and their communities. Of particular value, the book illustrates the co-benefits of multi-party resilience planning: faster approval times; reduced litigation; ability to monetize benefits such as positive health outcomes; the economic benefits of cooperation (for example, capacity building through financing climate planning and resilience across public, private, and other sources of funding); and developing a shared perspective. The book will be of great interest to business managers, policymakers, and community leaders involved in combating climate change, and researchers and students of business, public affairs, policy, environment, climate, and urban studies.

Book excerpt: Covering its historic development, important individuals, and central ideas and issues, this encyclopedia offers broad historical coverage of The Church of Jesus Christ of Latter-day Saints. Mormonism: A Historical Encyclopedia helps readers explore a church that has gone from being an object of ridicule and sometimes violent persecution to a worldwide religion, counting prominent businesspeople and political leaders among its members (including former Massachusetts governor and recent presidential candidate Mitt Romney). The encyclopedia begins with an overview of The Church of Jesus Christ of Latter-day Saints—six essays cover the church's history from Joseph Smith's first vision in 1820 to its current global status. This provides a context for subsequent sections of alphabetically organized entries on key events and key figures in Mormon history. A final section looks at important issues such as the church's organization and government, its teachings on family, Mormonism and blacks, Mormonism and women, and Mormonism and Native Americans. Together, these essays and entries, along with revealing primary sources, portray the Mormon experience like no other available reference work.
