Download or read book Law Reforms around the World written by Asif H Qureshi and published by Taylor & Francis. This book was released on 2023-12-01 with total page 365 pages. Available in PDF, EPUB and Kindle. Book excerpt: Encapsulating Law Reform requires the creation of a discreet space occupied with normative self-generation, self-correction, and self-adaptation in the very anatomy of law and the architecture of legal systems. This ‘living dynamic trait’ should be a hallmark of the genetic material in the modern-day institution of law. This edited volume sheds light on Law Reform in its domestic, comparative, regional, and international settings. It examines the process of Law Reform and explains the need for a constant appraisal to keep its wheels optimally operational. The book takes a holistic approach to understanding Law Reform and calls for such an approach in the very process of Law Reform. It begins by looking at Law Reform processes from a theoretical perspective. Thereafter, it sheds light on domestic Law Reform processes in civil and common law legal systems. This is followed by a focus on Law Reform at the international level with a critical appraisal of the International Law Commission (ILC), drawing on its performance in international economic and environmental law. Included in this consideration is also the role played in Law Reform by the IMF, World Trade Organization/World Intellectual Property Organization, Multilateral Development Banks, and the African Union Commission on International Law. This volume should appeal to students, serious scholars, policy makers, judges, and the community of national and international lawyers interested in bringing effective reform in the national and international arenas.

Download or read book National Uniform Legislation written by Guzyal Hill and published by Springer Nature. This book was released on 2022-08-11 with total page 185 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book aims to develop a conceptual framework upon which to draw for analysis of new and existing national reforms in Australia. Due to growth in the volume and complexity of national uniform legislation, law reform agencies, the Commonwealth, state and territory governments and policy institutions have more, rather than less, to do. This book explores how they are required to respond to debates among actors from divergent geographical, commercial and ideological backgrounds, who sometimes demonstrate irreconcilable differences in values and perspectives. From a policy implication perspective, this book summarises a vast quantity of original and complex data so that it can be applied in the field—among policymakers, reformers, legislative drafters, students and the wider audience of legal practitioners working with harmonised legislation in federations. This book acknowledges that uniform legislation is not a panacea for all legal challenges currently faced by federations. However, this book takes a step towards demystifying the many confusing factors that have obscured the underlying general principles. A working theory of ‘federal harmonisation’ enables ‘the art of the impossible’ to become a practical reality. This book condenses data on legislation in models. The models enable transparent, evidence-based decisions in the process of a federation’s harmonisation to progress regulatory best practices and achieve more reliable, sustainable results.
Download or read book Information Disclosure written by Julie-Anne Tarr and published by iUniverse. This book was released on 2001 with total page 330 pages. Available in PDF, EPUB and Kindle. Book excerpt: An insurance contract is one of the most significant documents an average consumer signs in the course of his or her adult life. It defines the scope and measure of protection available to the policy holder should the risk eventuate. Insurers similarly view the information supplied during contract negotiations as critical. As it provides a basis for assessing the risk inherent in issuing the policy, failure to disclose information fully and accurately can skew calculation of the risk level inherent in the deal and of the appropriate premium payable. For this reason, insurance contracts have traditionally been treated as a special category of business dealing. Unlike standard contracts based on caveat emptor, – let buyers beware – insurance contracts bind both insurers and consumers to a higher duty of honesty and good faith in their dealings with each other. Failure to fully disclose information that may affect an insurer’s calculation of risk in taking on the contract can potentially, therefore, result in the valid rejection of a policy holder’s claim.Given the potentially devastating consequences claim denial carries for policy holders, this book outlines the current legal regulatory framework governing this area and assesses its capacity to provide a just and efficient set of standards for the exchange of this information in the pre-contracting stage.
