Concerning the territorial sea, the coastal state enjoys full sovereignty to the right of innocent passage, while under the high seas rules all countries enjoy multifaceted uses of the sea qualified only by the limitations imposed by international law. The development of the exclusive economic zone ended this traditional dualism and ushered in guidelines that are embodied within the text of the LOS Convention. The Exclusive Economic Zone presents to academia and the general reading public a comprehensive study of the EEZ concept as it relates to the LOS Convention and state practice. The Exclusive Economic Zone shows that even through coastal states have the right to develop a 200 miles EEZ and that this right is an integral part of contemporary international relations, it is also true that the EEZ concept is shrouded in legal ambiguities. Participants negotiated every major issue of ocean use: jurisdiction in the coastal and contiguous zones, the territorial sea, and the new two-hundred-mile exclusive economic zone (EEZ); transit and overflight through straits and archipelagos; fisheries management in the EEZs and high seas; ocean environmental obligations; the right to conduct ocean science; and the management of deep seabed mineral exploitation. Negotiating the treaty required more than fifteen years and the consent of more than one hundred and fifty nations. The resulting treaty, composed of three hundred and twenty articles plus seven major annexes, represents the final product of the largest, longest, and most complex formal negotiation in modern times. Negotiating the New Ocean Regime analyzes both the substance of the problems at hand - what should be done about the oceans - and the process of the bargaining and negotiating. With law and history as a background, Robert Friedheim uses regime theory and resource economics to analyze ocean problems and bargaining/cooperation theory of negotiation. To evaluate the treaty through the eyes of the stakeholders, the author employs a multi-attribute utility model. Finally, he assesses the bargaining system - parliamentary diplomacy with consensus as the decisive rule - for its usefulness, limitations, and applicability to other current global problems.

Traditionally, legal-geographical interrelations have been dominated by scholars with backgrounds in geopolitics, economics, or geography. More recently, a new interdisciplinary approach has been developed with the aim of offering a fresh perspective on how law and geography intersect. There has been a steady growth in cross-disciplinary research in this field; how legal-geographical taxonomies interrelate has attracted attention from scholars and academics with a diverse range of backgrounds – namely, law, anthropology, and human/physical geography –, thus giving rise to several publications. Against this backdrop, the book adopts a legal comparative perspective and assesses ‘normative spatialities’, which are the outcomes of processes of legal-spatial production. In addition, the comparative analysis offers readers new insights on some traditional geographic features which are essential to legal studies (territorial identity, regional demarcation, territorial alternation, and place-name policy). Examples are drawn from several jurisdictions (both from the Global North and the Global South) and partly employ a diachronic perspective. As its subversive character is ideally suited to revealing policies and agendas, comparative law is used to identify the ethnocentric and colonial biases underpinning the use (and misuse) of legal geographic devices by policymakers and academics. In sum, the book presents legal geography as an interdisciplinary undertaking in which geographers and legal scholars can jointly examine common concepts in the historical, cultural, political and social contexts in which law is practised. The book transcends the boundaries between disciplines to engage in a fruitful dialogue on how the law can help to address the current socio-geographic and ecological crises.
