The book also addresses key substantive topics in international law, with reference to important contemporary foreign policy issues, such as (i) international human rights, (ii) the law of the sea, (iii) international environmental law, (iv) the use of force and the law of armed conflict, and (v) international criminal law. Key Features: New co-author Duncan Hollis of Temple Law School joins Stanford Law School’s Allen Weiner as the active authors of the book. Book International Law Achievements and Prospects

Download or read book International Law Achievements and Prospects written by Federico Mayor and published by BRILL. This book was released on 2023-12-28 with total page 1336 pages. Available in PDF, EPUB and Kindle. Book excerpt: The arrival of the International Law: Achievements and Prospects can fairly be described as a major event in international legal publishing. It has been written by international lawyers from the North, the South, the East and the West, whose differing origins and different, or even opposed, academic backgrounds have ensured that the book encapsulates and brings into focus `the main forms of civilization' and `the principal legal systems of the world'. The book's most distinctive feature is its international, multi-cultural and polyphonic nature. International Law: Achievements and Prospects aims to inform and to educate, to make the discipline of international law accessible to a very broad public, and to promote a meeting of minds on fundamental notions, key concepts, and the guiding principles of international law, over and beyond frontiers, ideologies and doctrines. In addition, it is intended to provide a framework for thought, to describe what international law is today, to specify its nature, define its purpose and show its strengths, and also to point out its weaknesses. All the contributing authors are or have been practitioners of international law. Their contributions express a global view of international law which helps to unravel the complex reality of the contemporary world. International Law: Achievements and Prospects has been produced under the auspices of UNESCO; its content also aspires to reflect, in some measure, the imprint of that Organization's sponsorship.

Transnational Law and Practice emphasizes the knowledge and skills that students need to solve the real-world transnational legal problems they are likely to encounter as lawyers in today’s globalized world—regardless of their field of practice and regardless of whether they are interested in international law as such. The casebook covers public international law and international courts; but unlike traditional international law casebooks, it urges students not to be “international law-centric” or “international court-centric” and gives them the resources to learn how to use national law and national courts, and private norms and alternative dispute resolution methods, to solve transnational legal problems on behalf of their clients. New to the Second Edition: Substantially re-written chapter on recognition and enforcement of foreign judgments to reflect recent important developments Excerpts from and discussion of new Supreme Court decisions on extraterritoriality, personal jurisdiction, the Alien Tort Statute and Foreign Sovereign Immunity Excerpts from the new Restatement (Fourth) of the Foreign Relations Law of the United States and the draft Restatement of the U.S. Law of International Commercial and Investor-State Arbitration Professors and students will benefit from: A practice-oriented approach that focuses on the knowledge and skills students need to solve real-world transnational legal problems on behalf of their clients. Comparative perspectives throughout. A team of authors with a wide range of expertise and experience in transnational litigation, arbitration, international law, constitutional law and transnational business transactions. An excellent alternative to classic public international law texts for introductory or first-year courses on international or transnational law. Multiple uses: With advanced material on transnational practice in U.S. courts, also ideal for upper-division courses on international civil litigation. Practical materials not traditionally included in public international law casebooks, such as materials on transnational commercial arbitration and conflict of laws. Extensive explanatory text to facilitate student learning and notes and questions that emphasize real-world lawyering, not just theory and doctrine. Review questions at the end of each chapter to help students synthesize, logically structure, and flowchart complex material.

Book International Law and the Use of Force

Download or read book International Law and the Use of Force written by Christine Gray and published by OUP Oxford. This book was released on 2008-07-17 with total page 2316 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the whole of the large and controversial subject of the use of force in international law; it examines not only the use of force by states but also the role of the UN in peacekeeping and enforcement action, and the growing importance of regional organizations in the maintenance of international peace and security. Since the publication of the second edition of International Law and the Use of Force the law in this area has continued to undergo a fundamental reappraisal. Operation Enduring Freedom carries on against Al Qaida and the Taliban in Afghanistan six years after the terrorist attacks of 11 September 2001. Can this still be justified as self-defence in the 'war on terror'? Is there now a wide right of pre-emptive self-defence against armed attacks by non-state actors? The 2006 Israel/Lebanon conflict and the recent intervention of Ethiopia in Somalia raise questions about whether the 'war on terror' has brought major changes in the law on self-defence and on regime change. The 2003 invasion of Iraq gave rise to serious divisions between states as to the legality of this use of force and to talk of a crisis of collective security for the UN. In response the UN initiated major reports on the future of the Charter system; these rejected amendment of the Charter provisions on the use of force. They also rejected any right of pre-emptive self-defence. They advocated a 'responsibility to protect' in cases of genocide or massive violations of human rights; the events in Darfur show the practical difficulties with the implementation of such a duty.

Book International Law

Download or read book International Law written by M. Rafiqul Islam and published by . This book was released on 2013 with total page 784 pages. Available in PDF, EPUB and Kindle. Book excerpt: International Law: Current Concepts and Future Directions is a scholarly, comprehensive and coherent study of contemporary international law. It identifies and describes existing international legal principles, norms, and standards and applies them to certain recent world events in order to test their operation, adequacy, consistency, and effectiveness in providing a stable and just world order. The book presents international law through the prism of the plural world composed of diverse stakeholders and argues that modern international law can no longer be contained within a single value-laden identity if the asymmetric rights and opportunities of the most and the least powerful states and people are to be addressed.International Law: Current Concepts and Future Directions examines the collaborative transformation of international law as a means to render it more universal and less Eurocentric in character and identity. The author articulates the transitional complexion of such changes and charts the new directions in which international law could and should evolve in this century and beyond. The blend of both theoretical and applied aspects of international law and its positioning in the growing horizon of internationalism makes this book an informative, engaging and stimulating text for students, academics, public officials and practitioners of international law and its related disciplines.Features* Covers traditional concepts and new and emerging ideas in international law* Critically examines existing principles and bases of international law to reveal their strengths and weaknesses* Highlights the experience of both developed and developing states* Provides a rich source of recent examples to illustrate concepts and the need for ongoing development
