Book Separating Powers International Law before National Courts

Download or read book Separating Powers International Law before National Courts written by David Haljan and published by Springer Science & Business Media. This book was released on 2012-10-30 with total page 335 pages. Available in PDF, EPUB and Kindle. Book excerpt: The more international law, taken as a global answer to global problems, intrudes into domestic legal systems, the more it takes on the role and function of domestic law. This raises a separation of powers question regarding law–making powers. This book considers that specific issue. In contrast to other studies on domestic courts applying international law, its constitutional orientation focuses on the presumptions concerning the distribution of state power. It collects and examines relevant decisions regarding treaties and customary international law from four leading legal systems, the US, the UK, France, and the Netherlands. Those decisions reveal that institutional and conceptual allegiances to constitutional structures render it difficult for courts to see their mandates and powers in terms other than exclusively national. Constitutionalism generates an inevitable dualism between international law and national law, one which cannot necessarily be overcome by express constitutional provisions accommodating international law. Valuable for academics and practitioners in the fields of international and constitutional law.

Book International Law Achievements and Prospects

Download or read book International Law Achievements and Prospects written by Federico Mayor and published by BRILL. This book was released on 2023-12-28 with total page 1336 pages. Available in PDF, EPUB and Kindle. Book excerpt: The arrival of the International Law: Achievements and Prospects can fairly be described as a major event in international legal publishing. It has been written by international lawyers from the North, the South, the East and the West, whose differing origins and different, or even opposed, academic backgrounds have ensured that the book encapsulates and brings into focus `the main forms of civilization' and `the principal legal systems of the world'. The book's most distinctive feature is its international, multi-cultural and polyphonic nature. International Law: Achievements and Prospects aims to inform and to educate, to make the discipline of international law accessible to a very broad public, and to promote a meeting of minds on fundamental notions, key concepts, and the guiding principles of international law, over and beyond frontiers, ideologies and doctrines. In addition, it is intended to provide a framework for thought, to describe what international law is today, to specify its nature, define its purpose and show its strengths, and also to point out its weaknesses. All the contributing authors are or have been practitioners of international law. Their contributions express a global view of international law which helps to unravel the complex reality of the contemporary world. International Law: Achievements and Prospects has been produced under the auspices of UNESCO; its content also aspires to reflect, in some measure, the imprint of that Organization's sponsorship.

Book The Intersection of International Law and Domestic Law

Download or read book The Intersection of International Law and Domestic Law written by Davíd Thór Björgvinsson and published by Edward Elgar Publishing. This book was released on 2015-11-27 with total page 201 pages. Available in PDF, EPUB and Kindle. Book excerpt: What are the theoretical and practical issues relating to the intersection between domestic and international law? This important new book discusses how general theories, including monism and dualism, transpire in practice. The author examines several key areas: the rules relating to treaty making and the ratification of treatises, the doctrine of automatic incorporation and transformation, the direct effect of international norms in the domestic system, and a discussion of the principle of consistent interpretation. With a focus on the European Convention on Human Rights, the author concludes that, although traditional theories are still relevant, they fall short in grasping the complexity of the different ways in which the legislator and the courts have given effect to international law on the domestic level. Students and scholars of international and domestic law will find this book to be useful in their studies. It will also be of interest to academics, judges, and practicing lawyers.

Book The Discourse on Customary International Law

Download or read book The Discourse on Customary International Law written by Jean d'Aspremont and published by Oxford University Press. This book was released on 2021-05-10 with total page 193 pages. Available in PDF, EPUB and Kindle. Book excerpt: Along with treaties, custom is one of the sources of international law. It is known to consist of two elements: state practice and opinio juris. While many studies have looked at traditional questions of how to identify customary law, this book takes a new and original approach. It looks instead at the structure of thought that lies beneath the arguments about customary international law. By examining these structures, the book uncovers surprising conclusions, and demonstrates what the author describes as the 'discursive splendour' of customary international law. The book guides the reader through an analysis of eight distinct performances at work in the discourse on customary international law. One of its key claims is that customary international law is not the surviving trace of an ancient law-making mechanism that used to be found in traditional societies. Indeed, as is shown throughout, customary international law is anything but ancient, and there is hardly any doctrine of international law that contains so many of the features of modern thinking. It is also argued that, contrary to mainstream opinion, customary international law is in fact shaped by texts, and originates from a textual environment. This book provides an engaging account of customary international law, whilst challenging readers to rethink their understanding of this fundamental part of the discipline.

Book International Law

Download or read book International Law written by M. Rafiqul Islam and published by . This book was released on 2013 with total page 784 pages. Available in PDF, EPUB and Kindle. Book excerpt: International Law: Current Concepts and Future Directions is a scholarly, comprehensive and coherent study of contemporary international law. It identifies and describes existing international legal principles, norms, and standards and applies them to certain recent world events in order to test their operation, adequacy, consistency, and effectiveness in providing a stable and just world order. The book presents international law through the prism of the plural world composed of diverse stakeholders and argues that modern international law can no longer be contained within a single value-laden identity if the asymmetric rights and opportunities of the most and the least powerful states and people are to be addressed.International Law: Current Concepts and Future Directions examines the collaborative transformation of international law as a means to render it more universal and less Eurocentric in character and identity. The author articulates the transitional complexion of such changes and charts the new directions in which international law could and should evolve in this century and beyond. The blend of both theoretical and applied aspects of international law and its positioning in the growing horizon of internationalism makes this book an informative, engaging and stimulating text for students, academics, public officials and practitioners of international law and its related disciplines.Features* Covers traditional concepts and new and emerging ideas in international law* Critically examines existing principles and bases of international law to reveal their strengths and weaknesses* Highlights the experience of both developed and developing states* Provides a rich source of recent examples to illustrate concepts and the need for ongoing development
