Book Law at the Frontiers of Biomedicine

Download or read book Law at the Frontiers of Biomedicine written by Shaun D Pattinson and published by Bloomsbury Publishing. This book was released on 2023-01-26 with total page 396 pages. Available in PDF, EPUB and Kindle. Book excerpt: How should judges and legislators address challenges arising at the frontiers of biomedicine? What if it became possible to edit the DNA of embryos for enhanced traits, gestate a fetus in an artificial womb, self-modify brain implants to provide new skills or bring a frozen human back to life? This book presents an innovative legal theory and applies it to future developments in biomedicine. This legal theory reconceptualises the role of legal officials in terms of moral principle and contextual constraints: 'contextual legal idealism'. It is applied by asking how a political leader or appeal court judge could address technological developments for which the current law of England and Wales would be ill-equipped to respond. The book's central thesis is that the regulation of human conduct requires moral reasoning directed to the context in which it operates. The link between abstract theory and practical application is articulated using future developments within four areas of biomedicine. Developments in heritable genome editing and cybernetic biohacking are addressed using Explanatory Notes to hypothetical UK Parliamentary Bills. Developments in ectogestation and cryonic reanimation are addressed using hypothetical appeal court judgments. The book will be of great interest to scholars and students of medical/health law, criminal law, bioethics, biolaw, legal theory and moral philosophy.

Book Health Law Human Rights And the Biomedicine Convention

Download or read book Health Law Human Rights And the Biomedicine Convention written by H. D. C. Roscam Abbing and published by Martinus Nijhoff Publishers. This book was released on 2005 with total page 295 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1997, the Council of Europe established the Convention on Human Rights and Biomedicine. It is generally regarded as an important addition to the general human rights laid down in the European Convention for the Protection of Human Rights and Fundamental Freedoms (1950), in particular with a view to the developments in modern biology and medicine. The Biomedicine Convention, which entered into force in 2000, is a framework treaty, meaning that a number of issues have to be dealt with or will be elaborated in additional Protocols; at this moment, three such Protocols have already been opened for signature. This volume of essays, written in honour of Henriette Roscam Abbing upon her retirement as Professor of Health Law at the University of Utrecht, gives an overview of some of the most important issues raised by the Convention. In six parts, this volume discusses the basic concepts and leading principles; the provision of services; the rights of patients; research; human tissue and genetics; and the implementation of the Convention.

Book Legal and Ethical Regulation of Biomedical Research in Developing Countries

Download or read book Legal and Ethical Regulation of Biomedical Research in Developing Countries written by Remigius N. Nwabueze and published by Routledge. This book was released on 2016-11-17 with total page 334 pages. Available in PDF, EPUB and Kindle. Book excerpt: There has been a rapid increase in the pace and scope of international collaborative research in developing countries in recent years. This study argues that whilst ethical regulation of biomedical research in Africa and other developing countries has attracted global attention, legal liability issues, such as the application of common law rules and the development of legally enforceable regulations, have been neglected. It examines some of the major research scandals in Africa and suggests a new ethical framework against which clinical trials could be conducted. The development of research guidelines in Uganda, Tanzania, Malawi and Nigeria are also examined as well as the role of ethics committees. Providing a detailed analysis of the law of negligence and its application to research ethics committees and their members, common law and constitutional forms of action and potential negligence claims, the book concludes by suggesting new protocols and frameworks, improved regulation and litigation. This book will be a valuable guide for students, researchers, and policy-makers with an interest in medical law and ethics, bioethics, customary law in Africa and regulation in developing countries.

Book Law and Legacy in Medical Jurisprudence

Download or read book Law and Legacy in Medical Jurisprudence written by Edward S. Dove and published by Cambridge University Press. This book was released on 2022-03-10 with total page 449 pages. Available in PDF, EPUB and Kindle. Book excerpt: Graeme Laurie stepped down from the Chair in Medical Jurisprudence at the University of Edinburgh in 2019. This edited collection pays tribute to his extraordinary contributions to the field. Graeme often spoke about the importance of 'legacy' in academic work and forged a remarkable intellectual legacy of his own, notably through his work on genetic privacy, human tissue and information governance, and the regulatory salience of the concept of liminality. The essays in this volume animate the concept of legacy to analyse the study and practice of medical jurisprudence. In this light, legacy reveals characteristics of both benefit and burden, as both an encumbrance to and facilitator of the development of law, policy and regulation. The contributions reconcile the ideas of legacy and responsiveness and show that both dimensions are critical to achieve and sustain the health of medical jurisprudence itself as a dynamic, interdisciplinary and policy-engaged field of thinking.

Readers... will come away with some of the tools for further debate." -- Publishers Weekly "Susan B. Rubin's splendid new book... offers positive, humane solutions to the frustrations that have given rise to the futility debate." -- Carl Elliott, Medical Humanities Review "Rubin offers a thorough and thought-provoking exploration of the concept of futility as a basis for medical decisions." -- Choice "... [the] brilliant analysis found in Rubin's [book] couldn't be more timely.... When Doctors Say No is the most thorough philosophical rebuttal to be found in the literature of medical futility as the basis for unilateral decisionmaking by physicians." -- Charles Weijer, Canadian Medical Association Journal Should physicians be permitted to unilaterally refuse to provide treatment that they deem futile? Even if the patient, or the patient's family, insists that everything possible must be done? In this book, philosopher and bioethicist Rubin examines this controversial issue. She offers a critique of the concept of medical futility and the debate surrounding it, and she calls for more public debate about the underlying issues at stake for all of us -- patients, families, health care providers, insurers, and society at large.
