Commencing with a review of relevant literature in linguistics, philosophy, semiotics and psychology, it examines biblical law in terms of its users, its medium and its message. It criticizes our use of the notion of 'literal meaning', at the level of both words and sentences, preferring to see meaning constructed by the narrative images that the language evokes. These images may come from either social experience or cultural narratives. Speech performance is important, both in the negotiation of the law and the narratives of its communication. Non-linguistic semiotic phenomena, utilizing other senses and involving such notions as space and time, also need to be taken into account. For the early biblical period, at least, conceptions of law based upon modern models need to be replaced by the notion of 'wisdom-laws'. Amongst the issues addressed in the course of the argument are the structure of the Decalogue, the role in the law of (Greenberg's) 'postulates', 'covenant renewal' and 'talionic punishment'.

Discussing particular laws found in the book of Leviticus—addressing issues such as the Day of Atonement, consumption of meat that still has blood, the Jubilee year, sexual and bodily contamination, and the treatment of slaves—Carmichael links each to a narrative. He contends that biblical laws did not emerge from social imperatives in ancient Israel, but instead from the careful, retrospective study of the nation’s history and identity.

The point of departure for this study is a type-scene analysis which reveals a common structure to theophany narratives. Beginning with the separation of the protagonist from human society, the text moves to a visual and verbal revelation by the Deity, and records a range of human reactions to the experience. Each of the texts concludes with a description of a more externalized reaction, which marks the carrying over of the experience into a larger societal framework. The analysis develops the underlying structural and contentual similarity among texts which have traditionally been understood as belonging to different literary genres. The discussion offers a nuanced treatment of the range of literary strategies employed by the narrative for addressing these elements. In addition to a detailed analysis of each of the above components of the type-scene, there is discussion of issues such as the idea of the lethal nature of the encounter and intertextual relations between the narratives. Book excerpt: Legal Friction: Law, Narrative, and Identity Politics in Biblical Israel tracks the mystery of narratives in the Hebrew Bible and their allusions to Sinai laws by highlighting intertextual allusions created by verbal resonances. While the second and the third parts of the volume illustrate allusions to Sinai narratives made by some narratives occurring in the post-Sinaitic era, twenty-three Genesis narratives are analyzed to show that the protagonists were bound by Sinai Laws before God supposedly gave them to Moses, anticipating the Book of Jubilees. Legal Friction suggests that most of Genesis was composed during or after the Babylonian exile, after the codification of most Sinai laws, which Genesis protagonists consistently violate. The fact that they are not punished for these violations implies to the exiles that the Sinai Covenant was unconditional. In addition, the author proposes that Genesis contains a hidden polemic, encouraging the Judean exiles to follow the revisions of laws of the Covenant Code by the Holiness Code and Deuteronomy. Genesis narratives, like those describing post-Sinai events, often cannot be understood properly without recognition of their allusions to biblical laws.
