Una de las materias que cabe destacar es el tratamiento de los datos sensibles de sus trabajadores comprendidos en las categorías especiales de datos personales, lo que añade un plus mayor de complejidad por varias razones. En primer lugar, por la indefinición de la regulación legal de estos datos sensibles en la norma de referencia que es el Reglamento General de Protección de Datos; en segundo lugar, por los derechos fundamentales implicados, como son el de intimidad, protección de datos y no discriminación; en tercer lugar, por la necesidad de establecer un sistema adecuado de garantías para proteger dichos derechos y también aplicar una serie de principios específicos en el proceso de tratamiento de los datos sensibles.
