Book excerpt: Just how International and European Community Law is being integrated into domestic legal systems is as yet not too well known. To gain a clear overview of this grey area requires more than knowing about the various constitutional rules. What is also needed is a study of little-known administrative practices and the attitudes of the national courts, where case-law is often as complex as it is diverse. When all these elements are taken into account, the general picture that emerges is a much more subtle one, transcending the classical positions based on the theories of monism and dualism. To grasp this reality and go beyond preconceived ideas, it seemed indispensable to make a thorough analysis of national practices. To this end, the International Law Centre of the University of Paris XIII (Cedin Paris XIII) took the initiative, in 1990, of setting up a network of European international lawyers to work on the theme International norms and legal barriers'. This book presents the outcome of the network's programme. The research was organized on the basis of a single questionnaire which provided the outline of a common workplan, to which each of the contributors has adhered. Detailed comparisons of national practices can now be made, relating in particular to international treaties, acts of international organisations and of the European Communities, and to unwritten international law. This is the first time that such a comprehensive and detailed survey has been made of all thirteen countries. Reading the national reports one after the other provides complete information on domestic practices; reading them crosswise gives a direct comparison between the different countries on specificissues.

Book excerpt: One of the most pressing issues in contemporary European societies is the need to promote integration and social inclusion in the context of rapidly increasing migration. A particular challenge confronting national governments is how to accommodate speakers of an ever-increasing number of languages within what in most cases are still perceived as monolingual indigenous populations. This has given rise to public debates in many countries on controversial policies imposing a requirement of competence in a ‘national’ language and culture as a condition for acquiring citizenship. However, these debates are frequently conducted almost entirely at a national level within each state, with little if any attention paid to the broader European context. At the same time, further EU enlargement and the ongoing rise in the rate of migration into and across Europe suggest that the salience of these issues is likely to continue to grow. This volume offers a critical analysis of these debates and emerging discourses on integration and challenges the assumptions underlying the new ‘language testing regimes’.

Bilingualism is a facet of nearly every country in the world and code-switching is a widespread characteristic of bilingual speech. An obvious and at the same time interesting aspect is that bilinguals will, of course, stay within one language when talking to monolinguals. However, when talking to other bilinguals, they will probably use both languages. Thus, in bilingual conversations, they often switch from one language to another and frequently even within an utterance. Such kinds of switches call for a special competence of the two languages involved. But how well the bilinguals have to know each of the languages is a justifiable question. These switches are not arbitrary since they may depend on the situation of the conversation, the topic of the conversation, the emotional aspects involved, the language preference of the speaker and the need to express the own identity. The goal of this book is to look in detail at code-switching in bilingual communication with the help of the present study on Russian-German bilinguals.

In the meantime, many second-generation speakers have become part of this group. The situation has resulted in various different constellations of language contact, both within the group of Romance languages and amongst typologically different and unrelated languages. Despite the fact that these contact scenarios present a wide range of research perspectives, there have been hardly any studies on Romanian as a language of migrants up until now. The volume Romanian in the Context of Migration brings together contributions on the Romanian language in Europe and in North America in the context of current migration linguistics. It includes studies on Romanian in Canada, France, Germany, Italy, Portugal, Slovenia and Spain and on the Romanian of those who return to Romania and Moldova. Über 25 % der Sprecher mit Rumänisch als L1 leben heute - infolge der Migration - außerhalb von Rumänien und der Republik Moldau, zumeist in anderen Ländern Europas, aber auch in Amerika und Australien. Inzwischen sind zahlreiche Vertreter der 2. Generation hinzugekommen. Aus dieser Situation ergeben sich unterschiedliche Konstellationen von Sprachkontakt, sowohl innerromanisch als auch mit typologisch verschiedenen und nicht verwandten Sprachen.
