Book excerpt: In large Latin American cities the number of dwellings in informal settlements ranges from one-tenth to one-third of urban residences. These informal settlements are caused by low income, unrealistic urban planning, lack of serviced land, lack of social housing, and a dysfunctional legal system. The settlements develop over time and some have existed for decades, often becoming part of the regular development of the city, and therefore gaining rights, although usually lacking formal titles. Whether they are established on public or private land, they develop irregularly and often do not have critical public services such as sanitation, resulting in health and environmental hazards. In this report from the Lincoln Institute of Land Policy, author Edesio Fernandes, a lawyer and urban planner from Latin America, studies the options for regularization of the informal settlements. Regularization is looked at through established programs in both Peru and Brazil, in an attempt to bring these settlements much needed balance and improvement. In Peru, based on Hernando de Soto's theory that tenure security triggers development and increases property value, from 1996 to 2006, 1.5 million freehold titles were issued at a cost of $64 per household. This did result in an increase of property values by about 25 percent, making the program cost effective. Brazil took a much broader and more costly approach to regularization by not only titling the land, but improving public services, job creation, and community support structures. This program in Brazil has had a cost of between $3,500 to $5,000 per household and has affected a much lower percent of the population. The report offers recommendations for improving regularization policy and identifies issues that must be addressed, such as collecting data with baseline figures to get a true evaluation of the benefit of programs established. Also, it shows that each individual informal settlement must have a customized plan, as a single approach will not work for each settlement. There is a need to include both genders for long-term effectiveness and to find ways to make the regularization self-sustaining financially. Any program must be closely monitored to insure the conditions are improved for the marginalized, as well as be sure it is not causing new informal settlements to be established.

Drawing on insights from economic geography and two centuries of experience in developed countries, the World Bank’s World Development Report 2009: Reshaping Economic Geography emphasizes key aspects that are fundamental to ensuring an efficient rural-urban transformation. Critical among these are land, as the most important resource, and well-functioning land markets. Regardless of the stage of urbanization, flexible and forward-looking institu- ons that help the efficient functioning of land markets are the bedrock of succe- ful urbanization strategies. In particular, institutional arrangements for allocating land rights and for managing and regulating land use have significant implica- ons for how cities deliver agglomeration economies and improve the welfare of their residents. Property rights, well-functioning land markets, and the management and servicing of land required to accommodate urban expansion and provide trunk infrastructure are all topics that arise as regions progress from incipient urbani- tion to medium and high density.

The study will be of great value to the government in the formulation of policies and strategies for controlling informal settlement and in addition researchers and scholars will use the study to provide the basis of future studies. To provide the basis of the study findings, the researcher relied on the following theories: Malthusian Theory of Population Growth, The Optimum Theory and Theory of Demographic Transition. Data was collected using questionnaires and guides from 96 household heads obtained through cluster sampling in Majengo Slum and 5 key informants purposively selected. It was then analyzed using Microsoft Excel Package presented in tables percentages. People residing in informal settlements face challenges of service delivery. This is mainly due to the fact that land was occupied illegally, thus impacting negatively on the environment. It was in the background of the above problem, that this study sought to establish the influence of informal settlement on the surrounding environment.

The research made use of the participatory approach in order to have diverse views on the research topi.The research adopted the use of questionnaires and interviews to collect data from slum dwellers and institutions in charge of managing land within Asawase such as Town and Country Planning Department(TCPD), Lands Commission(LC), Asokore Mampong Municipal Assembly (AMMA). From the study, it was observed that, the conditions in Asawase had deteriorated considerably leading to poor sanitation, substandard of housing, lack of basic services and facilities and low generating income activities. It was further established that, the institutions in charge of managing land face a lot of challenges in undertaking their duties, some challenges are, political influence, delay in the release of funds, failure in reviewing plans and inadequate logistics, land litigation and disputes were also major challenges in the managing of land in Asawase. Efficient land administration in urban areas could promote development of communities and enhance socioeconomic growth. Lastly, human resource and logistics should be adequate to make land service delivery efficient and make clients comfortable in their transactions with the institutions.

The other perspective, more critical, sees informality predominantly as a result of political exclusion, inequality, and poverty. Do we see urban informality as a fertile breeding ground for bottom-up democracy and more political participation? Or is urban informality indeed merely the result of a democratic deficit caused by governing autocratic elites and ineffective bureaucracies? This book displays a wide variety of political practices and narratives around these positions based on narratives conceived upon specific case cities. It investigates how processes of urbanization are politicized in countries in the Global South and in transition economies.
