Book Labor Relations and Labor Law in Japan

Book excerpt: This article discusses the relationship between Japanese labor law and employment customs, building on this rationalistic understanding of the Japanese employment customs. Our basic conclusion is as follows. The Japanese employment custom developed naturally through an agreement among the members of Japanese employment society and attained efficient economic performance up till the 1990s. During the time, the Japanese labor law mainly worked toward setting the stage for private bargaining and respected its agreement instead of enforcing the desirable result directly through legal regulations. Through this indirect approach toward labor relations in Japan, at least part of the Japanese labor law made a highly positive contribution to the attainment of economic efficiency innate in Japanese labor relations. After the 1990s, when the long-run stagnation occurred in Japanese economy, the merit of the Japanese employment custom diminished and needed reform. At this stage, the Japanese labor law has taken the stance of directly regulating the economy, particularly in the area of employment protection and working hours regulation. Due to this mismatched regulatory approach toward Japanese employment relations, the Japanese labor law has become one important factor that hindered the performance of the Japanese economy.

Book excerpt: The 1990s in Japan have been a period of far-reaching changes in Japanese society, which have not come to an end yet. These developments demand a reexamination of our accumulated knowledge of Japan. This volume looks at them from different perspectives; the contributions deal with issues from the fields of economy, education, political and social science. The volume is a collection of papers from the 2002 meeting of the German Association of Social Scientific Research of Japan (VSJF) at Halle-Wittenberg University.

Book Immigration Policy and Foreign Workers in Japan

Download or read book Immigration Policy and Foreign Workers in Japan written by H. Mori and published by Springer. This book was released on 1996-11-04 with total page 241 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the second half of the 1980s Japan has emerged as one of the new major destination countries for migrants from Asia. The migrant labour pool was then joined by Japanese descendants from South American countries in the 1990s. Japan's policy of keeping the labour market closed to foreign unskilled workers has remained unchanged despite the 1990 immigration policy reform, which met the growing need for unskilled labour not by opening the 'front-door' to unskilled workers but by letting them in through intentionally-provided 'side-doors'. This book throws light on various aspects of migration flows to Japan and the present status of migrant workers as conditioned by Japan's immigration control system. The analysis aims to explore how the massive arrival of migrants affected Japan's immigration policy and how the policy segmented the foreign labour market in Japan.

Book excerpt: As Japanese companies establish overseas production facilities at an ever more repid pace, it is increasingly important for people in the host countries to understand the preconceptions upon which the Japanese approach to industrial relations is based. This book traces the development of Japanese labour law and shows how labour law has been related to the prevailing social, economic and political circumstances.
