It is not many years since such legal provision as existed was embodied solely in the common law, that body of customs and adjudications that had come to have the sanction of the courts of England and America to such an extent that it became a clog to any progressive adjustment of law to changing eco nomic conditions. Clearly a policy shaped in the days of the hand loom and forge and transportation by horse power could poorly provide for the needs of industry to - day. The common law reduced to a codified form is printed as an appendix to this volume, and sufficient evidence of its inadequacy is afforded if this code is compared with the scores of statutes compiled in the fifteen-hundred-page volume of labor laws, forming the Twenty second Annual Report of the United States Commissioner of Labor, presenting the enactments of the legislatures of the various states in their attempt to prescribe the respective rights and duties and to safeguard the physical and economic interests of the parties to the labor contract. There is a feeling, only too well founded, that, despite legislation, the dead hand of outgrown doctrines of the common law restrains the courts in their con struction of statutes; but that there is encouraging advance in this respect cannot be gainsaid. Book excerpt: Excerpt from Child Labor Legislation in the United States All laws establishing minimum ages for employment in particular occupations or industries are included except those which seem to be designed primarily for the protection of the public rather than of the children, as laws establishing minimum ages for chauffeurs, motion-picture operators, or masters, pilots, and engineers of steam vessels; for the protection of other employees, as laws establishing minimum ages for hoisting engineers in mines; or for the protection of both the public and other employees, as laws establishing minimum ages for steam-boiler engineers. This division according to the purpose of the law, whether for the protection of the child or of others, was not always easy to make, and in some instances other practical considera tions governed. In a law regulating the age at which an elevator boy may be employed, for example, protection of the public is probably a more important factor than protection of the boy. Nevertheless, Operating an elevator is an occupation in which young boys are so fre quently employed that these laws are included. Laws forbidding em ployment agencies to send women or minors to immoral resorts are given as attempts to enforce an age limit, either for girls or for both sexes, in certain occupations where they will be exposed to immoral influences. Similarly, laws which prohibit the overworking of chil dren or provide that girls shall not stand constantly moan practically the establishment of minimum ages for certain kinds or degrees of intensity of work. In general, laws establishing minimum ages for employment in saloons are included even for prohibition States, but the prohibition States are noted in the tables. Book excerpt: Excerpt from Labor Laws for Women in Germany The factory law of Germany differs from French or English, in so far as it does not constitute a separate body of enactments, and 15 not distinct, as with us, from provisions against truck, control of markets, or regulation of contract between employer and employed. The German factory law forms a part of the industrial code of the empire Which applies as a whole to all trades and industries. The scope of the industrial code is very wide, and includes infer (did the formation of guilds and work men's committees, the regulation of the labour contract, the arbitra tion of disputes, the regulation of labour organisations, etc. Prussia, as might have been expected, took the initiative in industrial legislation, and afterwards imposed the same legislation, with some modifications and exceptions, upon the whole Empire. The Edict of 1807 abol1shed serfdom in Prussia, and made free the right to possess land. In 1808 a circular was issued proclaim ing the right of citizens to engage in such occupations as they desired. Exclusive privileges and industrial monopolies were abolished in several subsequent orders. In 181 1 industry was freed by removing the compulsory membership of trade guilds, and permitting persons not members to employ labour and have apprentices. In 1845 an impor tant Labour Act (gewerbeordnung) was passed, which confirmed and extended industrial liberty, and removed some still-existing restrictions. But it also made an effort to maintain the old guilds, in order that the education of apprentices might be preserved and safeguarded. The exercise of a trade was subordinated only to the possession of the necessary aptitude for its prosecution, to a fixed domicile, and to a declaration to the local authorities. In exceptional cases only, where special intelligence was required, or the industry was dangerous to the public, Were special authorisations required. This provision is still in force the law enumerates certain dangerous or unhealthy trades, which are only to be carried on subject to special authorisation, which is dependent on the fulfilment of specified conditions of health and safety. Such are, for instance, chemical and gas works, foundries, starch factories, wool-sorting works, lead enamelling works, and others. The conditions of authorisation may and often do include conditions for the protection of workers employed. It is interesting to see that this regulation, which has attracted the attention of foreign observers and is rightly regarded as one of the most advanced provisions ofexisting factory law, is connected through the enactment of 1845 with the regulations of the ancient guilds.
