Drawing on a sample of recent Spanish legislation, the papers collected here analyse (critically) the rationale of several laws or legislative measures as it can be reconstructed from the respective parliamentary discussions. All issues covered have given rise to intense political, legal and social controversy: they range from the combat against gender violence, the legal status of bullfighting, the protection of crime victims and the so-called ‘push-backs’ at the border, to the regulation of euthanasia, the minimum living income, underage girls’ access to abortion, and joint child custody. The volume is organised into two main parts. The first group of case studies adopt a legisprudential perspective and examine parliamentary deliberations in the light of the theory and methodology of legislative justification; the contributions in the second part follow approaches that fall outside – but are largely compatible with –legisprudence, and deal with aspects such as the rhetorical strategies employed by MPs when debating bills, and the role of elected legislators as constitutional interpreters.

Book excerpt: Despite legal and social advances in the past two decades, sexual and gender minorities continue to face widespread discrimination and violence in many countries. This discrimination and violence lead to exclusion, which adversely impacts their lives, as well as the communities and economies in which they live. A major barrier to addressing this stigma and sexual orientation and gender identity(SOGI)-based exclusion is the lack of SOGI-specific data. Robust, quantitative data on di‚fferential development experiences and outcomes of sexual and gender minorities--especially those in developing countries--is extremely thin. This paucity of data jeopardizes the achievement of the Sustainable Development Goals and countries' commitment to the principle of 'leaving no one behind' in the eff‚ort to end poverty and inequality. 'Equality of Opportunity for Sexual and Gender Minorities' assesses the unique challenges that sexual and gender minorities face in six important areas: (i) Criminalization and SOGI (ii) Access to education (iii) Access to the labor market (iv) Access to public services and social protection (v) Civil and political inclusion (vi) Protection from hate crimes. This report cov‚ers numerous policy recommendations to prevent and eliminate discriminatory practices in all of the areas covered. It also seeks to inflŽuence legislative changes and support research on institutions and regulations that can ultimately lead to poverty reduction and shared prosperity. At the same time, it acknowledges that the mere existence of inclusive laws and regulations does not ensure that sexual and gender minorities are free from discrimination--the enforcement of those laws is crucial. This publication, the first in a series of studies, will be expanded from the 16 countries included here to a wider set of countries for more in-depth quantitative analysis and to identify possible correlations with socioeconomic outcomes. It will seek to deepen knowledge, facilitate peer learning of good practices, and encourage reforms to increase the inclusion of sexual and gender minorities.

Book excerpt: El creciente papel que la víctima ha ido adquiriendo en diferentes ámbitos del Derecho penal es algo que suscita interés, y también preocupación, desde hace tiempo. Tras el olvido o neutralización de que fue objeto desde que el Estado pasó ejercer el monopolio del ius puniendi a partir del siglo XVIII, en la segunda mitad del siglo XX tuvo lugar lo que se denominó como redescubrimiento o resurgimiento de la víctima, que reivindicaba una mayor presencia de esta en la administración de justicia. Más allá del papel que pueden desempeñar en los delitos perseguibles a instancia de parte, en los supuestos en los que el perdón del ofendido puede operar como causa de extinción de la responsabilidad penal o, en general, a través del ejercicio procesal de la acusación particular, las pretensiones de las víctimas han ido persiguiendo objetivos cada vez más ambiciosos. Así, se plantea la posibilidad de que la víctima no sólo sea parte en el proceso penal sino, más allá, en el de la ejecución de la pena, pudiendo influir en cuestiones tan relevantes como la concesión del tercer grado o la libertad condicional del condenado. Asimismo, su presencia se ha incrementado en un terreno como es el político-criminal, donde las asociaciones de víctimas aspiran a ejercer de inspiración o guía a la hora de confeccionar o reformar las leyes penales. También se ha invocado un supuesto derecho de la víctima al castigo del autor del delito, tratando de incorporar los intereses de esta dentro de los fines de la pena, objetivo también pretendido a través de la reparación del daño en su papel de atenuante de la responsabilidad penal. Y, adicionalmente, se encuentra todavía abierto el papel que la voluntad y el comportamiento de la víctima puede llegar a jugar dentro de la estructura de la teoría jurídica del delito, normalmente en sede de injusto. El papel de la víctima, entonces, parecería tener una creciente importancia tanto a la hora de verificar la existencia de un delito, como en el momento de articular las consecuencias jurídicas del mismo (desde un plano legislativo y desde un plano efectivo). Todas estas cuestiones, y algunas más, son precisamente las que se abordan en las diferentes aportaciones que ahora se publican en este libro y que son el resultado escrito del III Seminario de Derecho penal de la Universidad Autónoma de Madrid.

Esta idea se materializó, finalmente, en la aprobación de la Ley 4/2015, de 27 de abril, del Estatuto de la víctima del delito, desarrollada por el Real Decreto 1109/2015, de 11 de diciembre. Pues bien, en la presente obra se aborda el estudio de los derechos básicos de que son titulares las víctimas en el marco del sistema penal español.
