Book excerpt: Il volume vede la sua alba in un momento di grande fermento in campo ambientale: solamente pochi mesi prima della sua pubblicazione, entrano in vigore tre fondamentali decreti correttivi (d.l. n. 128 del 29 giugno 2010, d.l. n. 205 del 3 dicembre 2010, d.l. n. 219 del 10 dicembre 2010), incidenti in misura notevole sulla disciplina del Testo Unico Ambientale. L'introduzione del SISTRI costituisce la nota di maggiore rilievo in tale ambito, anche in virtù della rilevanza assunta a livello pratico, oltre che mediatico. Il reale profilo di originalità del volume, è costituito dalla multi-disciplinarità dell'approccio. L'obiettivo dei curatori si è concentrato sulla necessità di trovare una chiave di lettura per orientare l'interprete nella gestione di una materia di profonda complessità tecnica ed in continua evoluzione. Per tali motivi, si è chiesto ad esperti di diritto internazionale, comunitario ed amministrativo di affrontare le questioni, di loro esclusiva competenza, con una qualche ricaduta nel campo del diritto penale ambientale. A tale operazione, utile a tracciare confini e linee direttive della materia, si è aggiunto lo studio delle singole discipline penali, relative alla tutela dell'acqua, dell'aria, alla gestione dei rifiuti, nonché agli aspetti ambientali dell'urbanistica e dell'edilizia. Con il medesimo obiettivo, si analizzano poi principi di diritto penale sostanziale più rilevanti nella materia ambientale, oltre che le ricadute pratiche sul sistema produttivo, determinate ¿ per un verso ¿ dalla applicazione dei principi dettati dal d. lgs. 231/2001 e - per altro verso - dalle sanzioni amministrative. La completezza dell'opera, in unione al suo aggiornamento con le più recenti modifiche normative, rende il volume un strumento fondamentale per gli operatori del diritto, come anche per chi voglia avvicinarsi ai principi generali della materia. PRINCIPALI INNOVAZIONI SI RECENTE INTRODUZIONE III CORRETTIVO T.U.A. Dal 26 agosto è in vigore il terzo correttivo al testo unico ambientale, il Decreto Legislativo 29 giugno 2010, n. 128, che interviene sulla Parti I, II (Via, Vas, Ippc) e V (Aria) del D. lgs. 3 aprile 2006, n. 152, modificando le procedure per la valutazione di impatto ambientale e per la valutazione ambientale strategica, e dettando nuove disposizioni in materia di inquinamento atmosferico (con novità anche sanzionatorie). Viene inoltre introdotta all'interno del Codice ambientale (Parte II) la disciplina dell'autorizzazione integrata ambientale (Aia), con conseguente abrogazione del D. lgs. 18 febbraio 2005, n. 59. IV CORRETTIVO T.U.A. In data 25/12/2010 entra in vigore del Decreto Legislativo 3 Dicembre 2010, n. 205, che attua il provvedimento comunitario e rivoluziona la gestione dei rifiuti nel nostro Paese, adattando la parte IV del 152/06 (testo unico ambientale) in preparazione al SISTRI e alle relative sanzioni. Esso costituisce il recepimento della Dir. 98/08/Ce sui rifiuti, a due anni dalla sua entrata in vigore e reca numerose ed importanti novità nella gestione dei rifiuti. V CORRETTIVO T.U.A. Il Decreto Legislativo 10 dicembre 2010, n. 219, riguarda la Parte III (Norme in materia di difesa del suolo e lotta alla desertificazione, di tutela delle acque dall'inquinamento e di gestione delle risorse idriche) ed in particolare, la sezione II, relativa alla tutela delle acque dall'inquinamento. È l'attuazione della Dir. 2008/105/CE relativa a standard di qualità ambientale nel settore della politica delle acque. La direttiva modifica diverse altre direttive europee che riportano i valori limite di particolari sostanze per gli scarichi. Viene anche recepita la Dir. 2009/90/CE che stabilisce, conformemente alla Dir. 2000/60/CE, specifiche tecniche per l'analisi chimica e il monitoraggio dello stato delle acque.

Book excerpt: The theft, trafficking, and falsification of cultural property and cultural heritage objects are crimes of a particularly complex nature, which often have international ramifications and significant economic consequences. Organized criminal groups of various types and origins are involved in these illegal acts. The book Crime in the Art and Antiquities World has contributions both from researchers specializing in the illegal trafficking of art, and representatives of international institutions involved with prevention and detection of cultural property-related crimes, such as Interpol and UNESCO. This work is a unique and useful reference for scholars and private and public bodies alike. This innovative volume also includes an Appendix of the existing legal texts, i.e. international treaties, conventions, and resolutions, which have not previously been available in a single volume. As anyone who has undertaken research or study relating to the protection of cultural heritage discovers one of the frustrations encountered is the absence of ready access to the multi- various international instruments which exist in the field. Since the end of the Second World War these instruments have proliferated, first in response to increasing recognition of the need for concerted multinational action to give better protection to cultural property during armed conflict as well as ensuring the repatriation of cultural property looted during such conflict. Thus the international community agreed in 1954 upon a Convention for the Protection of Cultural Property in the Event of Armed Conflict. That Convention, typically referred to as the Hague Convention of 1954, is now to be found reproduced in the Appendix to this book (Appendix I) together with 25 other important and diverse documents that we believe represent a core of the essential international sources of reference in this subject area. In presenting these documents in one place we hope that readers will now experience less frustration while having the benefit of supplementing their understanding and interpretation of the various instruments by referring to individual chapters in the book dealing with a particular issue or topic. For example, Chapter 9 by Mathew Bogdanos provides some specific and at times rather depressing descriptions of the application in the field of the Hague Convention 1954, and its Protocols (Appendices II and III), to the armed conflict in Iraq. Reference may also be had to the resolution of the UN Security Council in May 2003 (Appendix VI) urging Member States to take appropriate steps to facilitate the safe return of looted Iraqi cultural property taken from the Iraq National Museum, the National Library and other locations in Iraq. Despite such pleas the international antiquities market seems to have continued to trade such looted property in a largely unfettered manner, as demonstrated by Neil Brodie in Chapter 7. Fittingly, as referred to in the Preface to this book, the last document contained in the Appendix (Appendix 26) is the “Charter of Courmayeur”, formulated at a ground breaking international workshop on the protection of cultural property conducted by the International Scientific and Professional Advisory Council (ISPAC) to the United Nations Crime Prevention and Criminal Justice Program in Courmayeur, Italy, in June 1992. The Charter makes mention of many of the instruments contained in the Appendix while also foreshadowing many of the developments which have taken place in the ensuing two decades designed to combat illicit trafficking in cultural property through international collaboration and action in the arena of crime prevention and criminal justice.
