Nel presente libro viene esaminata la tutela della famiglia e i ricongiungimenti familiari nell’ambito delle Convenzioni internazionali a protezione dei diritti umani; il ricongiungimento familiare e la tutela della vita familiare nello spazio giuridico; diritti dei familiari del cittadino europeo nella normativa e nella giurisprudenza europea; la disciplina contenuta nelle direttive 2004/38/CE e 2003/86/CE; il rapporto tra diritto europeo al ricongiungimento familiare e il rispetto delle norme nazionali in materia di ingresso e di soggiorno degli stranieri. Una parte importante in questo lavoro viene dedicato al diritto al ricongiungimento familiare nel diritto interno, ossia la tutela dell’unita familiare in Italia a norma del Testo Unico immigrazione 296/98. The present book is a contribution to the clarification of operating procedures used by the current legislation of the European Union for the protection of the right to family unity, and in particular the right to family reunification of individuals. From a formal point of view the right to family reunification, enjoys international and national protection. This book examines the protection of family life and family reunification within the framework of international conventions on human rights, family reunification and the protection of family life in the area of justice, the rights of family members of European citizens in the EU legislation and the case law; the rules set by the Directives 2004/38/EC and 2003/86/EC, the relationship between EU legislation on family reunification and the respect of national rules governing the entry and residence of migrants. An important part of this work is dedicated to the right of family reunification in the national law, namely to protect the family unit in Italy in accordance with the Consolidated immigration no. 296/98.

Book excerpt: In this book, Christina Zuber outlines a theory of ideational policy stabilization to explain stable policy choices despite changing incentives. Historical legacies are frequently invoked in popular and academic accounts of the politics of migration, but the mechanisms of transmission are left underspecified. This work contributes to research on migration and to theories of public policy by arguing that the missing link between past events and present choices is ideational: initially a historical constellation of interests leads actors to defend policy ideas that match the historical environment, but over time, ideas can detach themselves from interests and stabilize into societal dispositions (shared values and identities). This occurs if elites build a discursive consensus around a policy idea, and if bureaucrats develop concomitant policy practices. The book's empirical section analyses ideational stabilization in Catalonia (Spain), which takes an inclusive approach to immigration, and in South Tyrol (Italy), where immigration is framed as a threat. The comparison shows that these differences can be explained by the political economy of historical industrialization and internal migration. Catalans were in the driving seat of industrialization, receiving unskilled migrant workers from the rest of Spain to boost their own economy. South Tyroleans, on the other hand, were in the passenger seat, perceiving incoming Italians as colonizers. Over time, socioeconomic conditions changed, and internal migration was replaced with international migration. Yet with historical ideas having stabilized into dispositions, political and administrative elites continued to understand immigration through the now-obsolete perspective of economic opportunity in Catalonia and ethnic competition in South Tyrol. It draws on neo-constitutional theories and builds on the assumption that fundamental labour rights, understood as rights aimed at protecting workers during their working life or after retirement, are the normative expression of founding values and can be balanced against equally axiological constitutional principles. The balancing of constitutional labour rights can be conducted by various institutional actors and by applying different techniques. This volume reviews the theoretical debates on judicial balancing and the approaches adopted by the Court of Justice of the European Union and the European Court of Human Rights, to proceed with a closer assessment of Italian and Spanish judicial traditions. In particular, it addresses the main profiles of the case law of the Italian and Spanish Constitutional Courts on labour and social law reforms adopted in the aftermath of the 2008 crisis, where balancing takes place between labour rights and economic principles. The analysis is focused on four main aspects: the fundamental labour rights in the balance; the role of the Courts; the technique applied by the Judges; and the constitutional interests subject to the balancing. It ultimately reveals that the axiological nature of fundamental labour rights is preserved and the economic and financial contingencies confirm their factual character, although they are occasionally recognised a prominent role in the ratio decidendi. The book will be a valuable resource for academics and researchers working in the areas of labour law, social security law, legal theory and constitutional law.
