S'il existe une théorie des contrats administratifs ainsi que des traités relatifs à la responsabilité administrative, aucun ouvrage n'est consacré au droit des obligations administratives. Cette notion unificatrice, fondement du droit civil français, n'a pas trouvé sa place en droit public. La notion d'obligation peut pourtant être utilisée en droit administratif car les rapports juridiques qu'elle caractérise s'y retrouvent. Son utilisation s'avère d'ailleurs particulièrement indiquée pour appréhender des phénomènes de circulation des créances, dettes ou contrats qui, en droit public comme en droit privé, constituent des modes de transmission des obligations. L'expression recouvre trois mécanismes juridiques : la cession de contrat, d'une part, la cession de créance et la subrogation personnelle, d'autre part. La cession de contrat a été consacrée sans difficulté par le juge administratif dès le XIXe siècle. Elle est apparue dans la jurisprudence au même moment que s'y construisait la notion de contrat administratif et le juge lui a rapidement bâti un régime juridique spécifique. La cession de contrat fournit ainsi l'exemple d'une technique contractuelle reconnue en droit administratif avant même d'avoir été étudiée en droit privé. La cession de créance et la subrogation personnelle sont des mécanismes qui ont été importés en droit administratif. Le transport des créances administratives s'effectue selon les mécanismes consacrés par le Code civil, mais cette réception d'instruments civilistes s'est accompagnée d'adaptations.
