Il provvedimento – entrato in vigore il 30 dicembre 2022 – interviene, a vario titolo: - sul sistema penale sostanziale, rivedendo il regime di procedibilità di numerosi reati; - sul sistema processuale, attraversando l’intero processo penale, nelle sue diverse fasi (dalle indagini preliminari, al dibattimento, ai riti alternativi, al processo in absentia, ai giudizi di impugnazione, fino all’esecuzione penale), nonché sul corredo delle disposizioni di attuazione e di coordinamento del codice di rito; - sul tessuto delle principali leggi complementari ai due codici, con particolare riferimento alla disciplina sanzionatoria delle pene sostitutive delle pene detentive brevi e delle pene pecuniarie. Un titolo autonomo del decreto è dedicato alla disciplina organica della giustizia riparativa, autentico novum dell’intero progetto riformatore. Il volume, dando conto dell’impatto sistematico della riforma e di tutti gli istituti novellati, esamina l’intera disciplina di nuovo conio lungo i suoi tre pilastri costitutivi - la riforma del processo penale, le modifiche al regime sanzionatorio e l’introduzione della giustizia riparativa - offrendo una disamina completa delle principali questioni applicative e di diritto intertemporale prospettabili a prima lettura. Questo volume raccoglie i contributi pubblicati sui n. 41, 42, 43, 44 e 45 del 2022 e sul n. 2 del 2023 di Guida al Diritto, revisionati e aggiornati – a cura di Aldo Natalini – alle ultime modifiche apportate dal Dl 162/2022, convertito, con modificazioni, in legge 199/2022.

A seguire gli approfondimenti curati dagli Autori di riferimento di Guida al Diritto, divisi in tre nuclei essenziali. Il primo nucleo riguarda le questioni problematiche, cioè il fattore organizzativo, l'istituto dell'improcedibilità e i criteri di priorità per l'esercizio dell'azione penale. Il secondo nucleo attiene, invece, alle disposizioni immediatamente in vigore dal 19 ottobre contenute nell'articolo 2 della delega. Il terzo e ultimo nucleo, infine, riguarda la delega penale in senso stretto, cioè l'articolo 1 della legge 134/2021; le materie interessate dalla delega penale sono molteplici e riguardano sia la fase precedente al giudizio penale che quella successiva, nonché alcuni aspetti del processo in senso stretto. Si è trattato, infatti, semplicemente di mettere nero su bianco e raccogliere gli interventi tenuti nel corso dell’ormai abituale appuntamento degli studenti dell’Università “Roma Tre” con il Seminario “Cultura della prova”, inaugurato dalle Cattedre di Diritto processuale penale oltre dieci anni fa, come cristallizzato nel primo dei Volumi che nel 2014 aveva inaugurato la nostra Collana intitolata “Processo penale e politica criminale”. Né più né meno. Eppure: al di là della naturale modestia nell’approccio alle tematiche qui sviluppate, dettato da esigenze prettamente didattiche, non rappresenta impresa insignificante quella rivolta a fornire agli studenti altrettante chiavi di lettura per orientarsi nel frastagliato panorama offerto dalla riforma introdotta con d.lgs. 10 ottobre 2022, n. 150, recante “Attuazione della legge 27 settembre 2021, n. 134, recante delega al Governo per l’efficienza del processo penale, nonché in materia di giustizia riparativa e disposizioni per la celere definizione dei procedimenti giudiziari”, più semplicemente noto come Riforma Cartabia dal nome dell’allora Ministro della Giustizia. La vocazione “efficientista” dell’intervento non era mai stata nascosta dagli stessi riformatori e viene ripercorsa da Giovanni Paolozzi nel saggio che funge da battistrada alla raccolta dei presenti scritti e si assume la responsabilità di tracciare una carrellata proemiale. Ha avuto la bontà di fare da “chioccia” alla nidiata di commenti articolatisi durante gli incontri seminariali, come del resto ha sempre fatto negli anni, con una pazienza dimostratasi infinita.

A tali fini, il volume pone in evidenza le profonde intersezioni tra la disciplina sostanziale e la dinamica processuale, intese dal d. lgs. n. 150 del 2022 come un sistema integrato. Il d.lgs. 10 ottobre 2022, n. 150 ha completato la Riforma “Cartabia”, attuando i criteri direttivi contenuti nella legge-delega 27 settembre 2021, n. 134. Si intende così realizzare l’obiettivo ambizioso del Piano nazionale di ripresa e resilienza (P.N.R.R.) di ridurre del 25% la durata dei procedimenti penali, mediante un recupero di efficienza del sistema di giustizia penale. Si tratta forse del più incisivo intervento legislativo dall’approvazione del Codice di procedura penale del 1988. Le novità investono, infatti, l’intera sequenza procedimentale, dall’iscrizione della notizia di reato, all’udienza preliminare, al giudizio, fino alle impugnazioni e alla fase esecutiva. In stretta correlazione, si incide anche sul sistema sanzionatorio del Codice penale, sulla depenalizzazione in concreto dei reati e si introduce la prima regolamentazione organica della giustizia riparativa, che, in virtù dei suggerimenti sovranazionali, si propone di implementare forme non tradizionali di risposta al reato mediante il dialogo tra vittima e persona alla quale il reato è attribuito. Il tentativo ambizioso e risalente di valorizzare la finalità rieducativa della pena si dovrà confrontare, in via inevitabile, con le consuete ragioni di deflazione prima del processo e poi della popolazione carceraria. La curatela del volume, affidata a docenti di diritto penale e di diritto processuale penale, ne garantisce la vocazione interdisciplinare. I contributi sono redatti da qualificati esponenti dell’accademia, della magistratura e dell’avvocatura, favorendo l’analisi completa degli istituti. Il testo si rivolge a tutta la comunità di studiosi del diritto e del processo penale, ai magistrati, alla classe forense e a tutti gli operatori del diritto. Although a wide range of evidence-based psychosocial interventions are currently in use, most consumers of mental health care find it difficult to know whether they are receiving high-quality care. Although the current evidence base for the effects of psychosocial interventions is sizable, subsequent steps in the process of bringing a psychosocial intervention into routine clinical care are less well defined. Psychosocial Interventions for Mental and Substance Use Disorders details the reasons for the gap between what is known to be effective and current practice and offers recommendations for how best to address this gap by applying a framework that can be used to establish standards for psychosocial interventions. The framework described in Psychosocial Interventions for Mental and Substance Use Disorders can be used to chart a path toward the ultimate goal of improving the outcomes. The framework highlights the need to (1) support research to strengthen the evidence base on the efficacy and effectiveness of psychosocial interventions; (2) based on this evidence, identify the key elements that drive an intervention's effect; (3) conduct systematic reviews to inform clinical guidelines that incorporate these key elements; (4) using the findings of these systematic reviews, develop quality measures - measures of the structure, process, and outcomes of interventions; and (5) establish methods for successfully implementing and sustaining these interventions in regular practice including the training of providers of these interventions. The recommendations offered in this report are intended to assist policy makers, health care organizations, and payers that are organizing and overseeing the provision of care for mental health and substance use disorders while navigating a new health care landscape. The recommendations also target providers, professional societies, funding agencies, consumers, and researchers, all of whom have a stake in ensuring that evidence-based, high-quality care is provided to individuals receiving mental health and substance use services.
