It draws on neo-constitutional theories and builds on the assumption that fundamental labour rights, understood as rights aimed at protecting workers during their working life or after retirement, are the normative expression of founding values and can be balanced against equally axiological constitutional principles. The balancing of constitutional labour rights can be conducted by various institutional actors and by applying different techniques. This volume reviews the theoretical debates on judicial balancing and the approaches adopted by the Court of Justice of the European Union and the European Court of Human Rights, to proceed with a closer assessment of Italian and Spanish judicial traditions. In particular, it addresses the main profiles of the case law of the Italian and Spanish Constitutional Courts on labour and social law reforms adopted in the aftermath of the 2008 crisis, where balancing takes place between labour rights and economic principles. The analysis is focused on four main aspects: the fundamental labour rights in the balance; the role of the Courts; the technique applied by the Judges; and the constitutional interests subject to the balancing. It ultimately reveals that the axiological nature of fundamental labour rights is preserved and the economic and financial contingencies confirm their factual character, although they are occasionally recognised a prominent role in the ratio decidendi. The book will be a valuable resource for academics and researchers working in the areas of labour law, social security law, legal theory and constitutional law.

The latter includes the recent revamping of fiscal rules of the Stability and Growth Pact, and calls for enhancing ‘flexicurity’ in EU labour markets. The lack of EU political leadership is a dead-weight loss to build a genuine economic and monetary union, and risks to blow-up the whole project. Further, it undermines the internal macroeconomic logic of a single currency like the euro, and gives a prominent non-democratic role to financial markets. As it happened in the past with the gold-standard, the euro condemns today the peripheral countries to a deflationary process which might last for a decade. A more pro-European approach is needed with both sides of the system (core and periphery) making the required adjustment efforts, though in the opposite way, to save the eurozone and Europe. “The theory of optimal currency areas remains the essential framework to understand the design failures of the eurozone. Chapters in this book advocate a reversal of this trend in favour of fair mutualization, so as to disperse these risks and share them more equitably between employers, the state, and society at large.

Book excerpt: Youth have always had higher unemployment rates – about twice or more than the average – as they are usually the last to be hired in an expansion and the first to be let go in a recession. In addition, young people engage in extensive job searching in their early years, and this can imply considerable job churning as both youth and employers look for a good match. This highlights the importance of facilitating the school-to-work transition and having early interventions to assist such youth before negative conditions set in. It also highlights the potential importance of determining those young people most “at risk” of long-term unemployment, and of targeting or streaming them into programmes that will yield the largest incremental net benefits given their characteristics. Unemployed youth without previous work experience often are not eligible for unemployment insurance benefits when they first enter the labour market. When they do receive job search assistance, they often face a bewildering array of programmes that are available to assist them, often with little guidance to help them select the programs that best meet their needs. Consequently, ensuring that today’s youth do not become a “lost generation” is an urgent matter. George Bernard Shaw once said that it is too bad that “youth is wasted on the young”, implying that youth do not realize the opportunities they have as youth and only see them as they get older. There is a danger, however, that many of today’s youth may be never have those opportunities and hence not even see them with hindsight. This book and others in the ADAPT Labour Studies Book-Series are intended to deal with these challenges, to make sure that youth is not wasted on the young.

This book, a collaboration between the Centre for European Studies and its member foundations, assesses government responses to the crisis at the national, EU and regional levels, and also offers policy recommendations. Governments should work with one another and with EU institutions to improve bank supervision and regulatory mechanisms. They should undertake fiscal consolidation measures, bearing in mind that government deficits and debt incur costs that burden future generations. Finally, they should undertake structural reforms such as creating flexible labour markets, increasing the retirement age and shaping efficient public institutions.

The most dangerous implication of this policy approach is, according to this study, that it is driving countries apart - misleadingly in the name of 'Europe', hence the title of the book 'divisive integration'. The main message of the book is that a gradual recovery is possible only if there is a change of course in individual countries that then triggers reactions in the policies of other countries and perturbations at the EU level. However, these changes in individual countries is no longer feasible without a green light or at least toleration from the level of the European institutions.
