Associée à la notion de justice, la proximité est entendue comme une qualité de l'appareil judiciaire. Pourtant, cette préoccupation n'est pas nouvelle pour la justice. Il est même possible de dire que celle-ci est très ancienne et continuellement présente dans son organisation et son exercice, mais aussi dans le langage de ses réformateurs. En outre, il n'existe pas dans la science juridique de définition clairement circonscrite de la proximité. Elle se révèle alors d'approche délicate en raison d'un usage contemporain manifestement excessif. Il existe en effet de multiple formes de proximité : géographique, humaine, du jugement, symbolique, temporelle etc. L'objet de la proximité en droit judiciaire est donc hétérogène et présente des manifestations traditionnelles et contemporaines très différentes. En outre, ses fonctions ont évolué, les traditionnelles ont été rénovées et corrigées pour tenir compte des évolutions de la société et des attentes des justiciables. Les nouvelles fonctions lui étant aujourd'hui attribuées permettent de s'interroger sur sa capacité à transformer la justice.
