Il mondo del minorenne e della persona vulnerabile si scontra inevitabilmente con i principi generali del Diritto penale, con le tutele in favore della vittima di reato e, al contempo, con il diritto dell'imputato ad un giusto processo. La delicatezza della situazione, per un verso, vede il bambino vittima di reato, al quale – una volta convocato per essere sentito nell'ambito di un procedimento penale, seppure con delle modalità protette – è chiesto di ricordare un momento traumatico del suo vissuto, rischiando di divenire per una seconda volta vittima e, per un altro verso, la posizione dell’imputato (spesso un prossimo congiunto) che inizia a vivere uno stato di sofferenza già dalla notificazione della notizia di reato perché l’avvio di un procedimento penale, indipendentemente dall'esito assolutorio o di condanna (che tarderà ad arrivare), è già una pena per un innocente. Va, peraltro, osservato che lo studio di quasi tutte le problematiche ivi trattate si scontra inevitabilmente con il quadro delle fonti sovrannazionali e, di conseguenza, con gli orientamenti, soprattutto, della giurisprudenza europea: ho sentito, sin dai primi capitoli, la necessità di domandarmi chi sia oggi la persona fragile e come venga tutelata dalle norme non solo penali, se sia portatrice di un interesse o di un diritto soggettivo, se è qualificabile come soggetto passivo del reato, in quei casi nei quali non detiene l’esercizio del diritto di querela. Come già anticipato, si tratta di un mero tentativo di risposte in una materia oggi molto attenzionata dal legislatore e dalla giurisprudenza interna e sovrannazionale. Claudia Carioti

On the one hand, its increasing importance is closely linked to institutional reforms that strengthened the European Court of Human Rights' reputation vis-a-vis the Member States. On the other hand, and even more importantly, the ECHR's significance arises from a changing perception of its constitutional potential. Starting with the assumption that the ECHR is transforming the European constitutional landscape, this book shows that the European Convention raises unprecedented problems that involve, first of all, its own theoretical status as constitutional instrument that ensures the protection of human rights in Europe. Changing paradigms concerning its incorporation in domestic law, as well as the growing conflicts about the protection of some rights and liberties that are deeply rooted in national legal contexts (such as teaching of religion, bio law, and rights of political minorities), are jointly examined in order to offer a unified methodology for the study of European constitutional law centered upon human rights. For a detailed analysis of these issues, the book examines the different facets of the ECHR's constitutional relevance by separating the ECHR's role as a 'factor of Europeanization' for national constitutional systems (Part I) from its role as a veritable European transnational constitution in the field of human rights (Part II). Consequently, the concept of human dignity spread throughout Europe and, in the context of human rights, became a fundamental legal concept.
