Pourtant, l'exploitation des droits sur les créations ornementales est susceptible de générer des valeurs économiques pouvant contribuer à la réalisation des objectifs de développement des pays africains. L'efficacité d'une telle valorisation est entre autres tributaire de l'existence d'un système de protection servant de tels objectifs, ainsi que d'une réglementation internationale favorisant l'exploitation transnationale des dessins et modèles industriels, et tenant compte du niveau et des besoins de développement des pays africains. La présentation du système des dessins et modèles industriels de l'OAPI permet d'examiner si ces préoccupations sont prises en compte dans son organisation et son fonctionnement, et de proposer des mesures en vue de faire de ces objets de propriété intellectuelle un outil efficace de développement économique et social des pays membres de l'OAPI en particulier et des pays africains en général.

La loi du 14 juillet 1909 sur la protection des dessins et modèles représentait la tradition juridique française en la matière. Cette loi a consacré pleinement la théorie de l’art qui a régné durant tout le 20ème siècle. Pour conséquence de cette théorie, un dessin et modèle industriel était protégé cumulativement et automatiquement par le droit d’auteur et le droit des dessins et modèles. La durée de protection était donc trop longue ; d’ailleurs, l’ancien droit des dessins et modèles était complètement absorbé par le droit d’auteurs en excluant certaines catégories de créations industrielles. La directive communautaire du 13 octobre 1998 sur la protection juridique des dessins et modèles provoque un grand trouble pour appliquer la théorie de l’unité de l’art en France. Tout d’abord, elle définit l’objet protégeable de manière très objective qui n’est plus compatible avec la notion d’objet protégeable en droit d’auteur. En second lieu, l’appréciation des conditions de protection dans le nouveau droit des dessins et modèles est désormais relative. En conclusion, l’application de la théorie de l’unité de l’art n’est qu’artificielle sous l’empire du nouveau droit des dessins et modèles. Cette théorie n’a plus de fondement juridique. La jurisprudence et la doctrine actuelles ne prennent pas en compte cette innovation du nouveau droit. Cette attitude très conservatrice n’est qu’une habitude intellectuelle fâcheuse. Désormais, la fin du cumul absolu est inscrite dans l’interprétation unifiée que la Cour de justice de l’Union européenne donnera du nouveau droit des dessins et modèles introduit pas la directive et le règlement.
