At a European level, the tendency is to accept the protection of software through patent law in some cases. With this in mind, the European Commission has submitted a draft Directive on the patentability of software. However, this project has met with very strong opposition from the partisans of free software. There is therefore a distortion of case law between the French judge and the European judge on the patentability of software. It is also interesting to compare this distortion with the software protection system in the United States, which accepts its protection via patent law. A legal discussion is therefore required on this subject, with a view to harmonisation of the protection systems in a context of globalisation. To do this, the meaning of "software" and "patentable invention" must be defined much more precisely, and it must be determined whether the conditions of patentability (novelty, inventive activity, industrial application) in France and in Europe are transposable to software. Moreover, within the framework of a comparative study, we should take inspiration from the legislation and case law of the United States.

La directive a pour objectif prioritaire de rendre interopérables les systèmes informatiques. En conséquence, il a été institué une protection spécifique des programmes d'ordinateur par le biais de modifications apportées au régime du droit d'auteur. En contrepartie des droits d'exploitation attribués à tout auteur de logiciel, des dérogations de taille ont été introduites par la nouvelle loi au profit de l'utilisateur légitime ; la plupart du temps, ce dernier peut, à défaut de stipulations contractuelles l'interdisant, accomplir des actes auparavant interdits, tels la copie, l'adaptation, la modification ou la correction des erreurs. En outre, de nouveaux droits sont accordés à l'utilisateur comme celui d'analyse et de décompilation, ainsi que la possibilité de nantir des droits d'exploitation sur le logiciel. Le présent mémento-guide a pour objet de définir les nouvelles règles applicables aux logiciels à compter de la loi du 10 mai 1994, d'une part en mettant en relief les apports de la loi récente par rapport au régime de la loi de 1985, et, d'autre part, en envisageant concrètement les adaptations contractuelles qui s'imposent à tout concepteur, fabricant ou utilisateur de logiciel.
