Book excerpt: En un mundo globalizado donde se ha incrementando notablemente la competencia a nivel empresarial y donde la innovación, las nuevas tecnologías y la corta vida de los productos en el mercado determinan la exigencia de los consumidores, el diseño industrial en todas sus modalidades, registrado y no registrado ha adquirido una nueva perspectiva como bien intangible, en cuanto se ha visto interesado por nuestro Derecho. La protección del diseño se rige (aparte de las disposiciones de diseño nacionales específicas) por el Reglamento de diseño comunitario de la UE (6/2002). La regulación fue el resultado de más de 10 años de discusión, que al principio se enfocaron en la protección de repuestos. Finalmente, los Estados miembros llegaron a un valioso compromiso, proporcionando protección comunitaria de dos niveles para todo tipo de diseño industrial mediante diseños no registrados y registrados. La finalidad de los dibujos y modelos no registrados se precisa en la Exposición de Motivos del RCE al expresar que en algunos sectores se crea un gran número de dibujos y modelos que con frecuencia tienen una vida comercial muy breve, por lo que requieren protección sin necesidad de cumplir los lentos trámites de registro, y para los que la duración de dicha protección tiene una importancia menor. El dibujo o modelo comunitario sería muy ventajoso para aquellos sectores en los que se crean numerosos dibujos y modelos, casi siempre de vida efímera, en períodos breves de tiempo y, de los cuales, tan sólo una parte se comercializan en su momento. Queda claro que la intención del legislador comunitario al crear esta nueva modalidad de propiedad industrial no es otra que la de salvar o superar el vacío legal que en muchas ocasiones podrían encontrar los pioneros de dibujos o modelos industriales en estos sectores, donde la vida del producto es relativamente corta, pero ¿realmente puede afirmarse la efectividad de esta nueva figura jurídica para los titulares de dibujos o modelos comunitarios en estos determinados sectores? Esta tesis tiene como objetivo examinar el régimen jurídico del dibujo o modelo comunitario no registrado. El problema que se plantea es el de su efectividad en la práctica. Pues entendemos, como el legislador comunitario, salva uno de los principales obstáculos referidos a este sector, el arduo y largo proceso de registro pero, sin embargo, ha pasado por alto otros inconvenientes que bien podrían operar como la causa de que estos titulares se encuentren en desamparo ante los diferentes instrumentos jurídicos existentes.

Moreover, in the being recognised more search for solution strategies the realisation is gaining ground that tourism must be viewed as a worldwide phenomenon whose development must be co-ordinated in a co-operative effort spanning regions and continents. That the preservation of biological diversity also requires global co operation has been confirmed by over 170 countries which have already acceded to the "Convention on Biological Diversity". It is thus an important task to provide the foundations for joint action. Germany, one of the largest source countries of international tourism, must feel particularly obligated in this regard. The report published here is the result of a research project com missioned by the German Federal Agency for Nature Conservation. The study pursued and examined the thesis that the Convention on Biological Diversity be used as a central instrument for arriving at international principles and regulations for combining nature conservation and tourism which could lead to a sustainable development of tourism. To further the discussion, the authors brought the study to a logical conclusion by working out a proposal for a "tourism protocol" additional to the existing Convention on Biodiversity. Such a protocol additional to the Convention would entail the stipulation of internationally binding implementation and regulations for achieving sustainable tourism.
