Une prévention administrative et pénale du risque professionnel s'est d'abord mise en place par l'instauration de règles de sécurité dont l'application relève de la responsabilité du chef d'entreprise. La prévention administrative et pénale, renforcée par une prévention civile et financière, fait l'objet d'une structure normative éclatée et fait intervenir de nombreux acteurs aux côtés du chef d'entreprise dont la prééminence est affirmée. Or, cette conception traditionnelle est altérée par les diverses évolutions économiques, sociales et juridiques contemporaines qui révèlent un décalage entre le système de prévention existant et les réalités auxquelles sont aujourd'hui confrontées les entreprises. Ainsi, se construit une nouvelle conception normative en matière de prévention qui consiste à proclamer un droit à la sécurité et à la santé au travail. Cette dynamique, qui se retrouve également en matière de réparation des préjudices physiques subis au travail, nécessite d'être amplifiée pour faire des salariés et de leurs représentants les véritables titulaires de ce droit. Dès lors, pour aboutir à une prévention effective, il incombe de la décloisonner par le développement de la pluridisciplinarité, le concours de tous les acteurs autour d'un objectif commun, et le développement d'une culture de la prévention qui seule permettra d'insérer l'idée de prévention dans les mœurs.
