Book excerpt: An unprecedented number of people is currently on the move seeking refuge in Europe. Large parts of European societies respond with anxiety and mistrust to the influx of people. Nationalist, anti-migrant parties from Slovakia over Germany to the UK have gained increasing support among the electorate and challenge the political mainstream. Europe is struggling how to respond. While the search for solutions is ongoing one pattern seems to be emerging: Fortress Europe is in the making. Unfortunately, few of these discussions and measures consider the structural root causes and dynamics of migration, the motives of migrants or societal challenges more thoroughly. This book seeks to address this deficit. Taking migration and asylum policies as a starting point, it analyses the various dimensions underpinning migration. In doing so, it identifies why receiving countries are in many ways part of the problem. To eschew an overtly Euro-centric perspective and stimulate a debate between science and politics, it contains contributions by academics and practitioners alike from both shores of the Mediterranean.

The emergence of a consistent ensemble of soft instruments in this policy realm in the 2000s unveiled an original pattern of EU policy formation. Can there be Europeanization without an EU competence? That is the question this original piece of research tackles. It shows how the way in which the policy emerged at EU level affected policy outputs adopted thereafter throughout the policy cycle. The book begins by looking at the situation in the Netherlands, which was the first EU Member State to introduce pre-entry integration requirements. It explores the historical and political origins of the Dutch Act on Integration Abroad and explains how, in this national context, integration has become a criterion for the selection of immigrants. It then examines how integration requirements must be evaluated from the point of view of European and international law, including human rights treaties, EU migration directives and association agreements and the law on non-discrimination. The book identifies the legal standards set by these instruments with regard to integration testing abroad and draws conclusions as to the lawfulness of the Dutch approach.
