Book excerpt: Depuis la fin du XIXeme siecle, la place de la faute en droit de la responsabilite civile est l'un des sujets les plus controverses du droit civil. La perennite du debat, opposant protecteurs et detracteurs de la faute, peut s'expliquer par la faible portee accordee a la distinction pourtant essentielle entre "faute-fondement" et "faute-condition." Apres avoir differencie ces deux concepts, l'ouvrage tente de circonscrire l'espace qu'ils occupent et devraient occuper en droit de la responsabilite civile. Il apparait tout d'abord que la faute n'a plus veritablement de place en tant que "fondement." Une analyse epistemologique, historique et positiviste de la responsabilite demontre que seul le damnum injuria datum est en mesure de repondre a cette qualification. Neanmoins, la faute beneficie d'une place en tant que "condition contingente et suffisante." Malgre l'objectivation du droit a reparation et l'admission d'immunites civiles, une faute dommageable ne doit demeurer sans responsabilite. Ce principe n'etant absolu qu'en presence de fautes qualifiees, l'auteur propose de consacrer un droit des delits speciaux qui pourrait trouver place dans un Code de la responsabilite civile.
