Con este objetivo, se realiza un análisis del terrorismo como comportamiento humano, pues es necesario establecer cuál es la realidad a la que quiere hacerse frente mediante la especial conminación penal que se reserva para los actos terroristas, delimitándolos frente a otros fenómenos con los que frecuentemente se confunde. Posteriormente se analizan los principales instrumentos internacionales sobre la materia, pues establecen determinadas obligaciones que España se ha comprometido a cumplir, así como la respuesta penal dada al fenómeno en dos de los países que han protagonizado la lucha contra el terrorismo global (Estados Unidos y Reino Unido). A continuación es objeto de estudio la evolución reciente de la legislación penal española antiterrorista (y su interpretación doctrinal y jurisprudencial) con el fin de identificar las tendencias que han marcado dicha evolución, para terminar con un análisis crítico y más detallado de la redacción vigente de los delitos de terrorismo, tratando de identificar el plus de desvalor que los caracteriza e incluyendo un breve estudio de ciertas categorías dogmáticas necesarias para la interpretación de los distintos tipos penales. El texto finaliza con la exposición de las conclusiones obtenidas, lo que incluye algunas propuestas de lege ferenda inspiradas en el concepto jurídico de terrorismo que se ofrece a lo largo de las páginas.

We are proud to bring together experts from universities, independent research organisations, governments, NGOs and the media.
