Personne physique, personne morale (société constituée conformément au droit commun, single ship company, société de quirataires, société d'État), groupe de sociétés, l'armateur peut être aussi bien celui qui possède, celui qui équipe, celui qui exploite le navire. Longtemps défini comme « celui qui arme le navire », l'armateur est aujourd'hui « celui qui exploite le navire en son nom, qu'il en soit propriétaire ou non » (art. 1er de la loi du 3 janvier 1969). L'auteur s'interroge sur la validité de cette définition. Dans la première partie de la thèse, centrée sur la propriété, il constate que le lien réel qui unissait traditionnellement le navire à son propriétaire tend à disparaître. Pourtant, aussi longtemps que le transport par mer aura un avenir, la fonction d'armateur est amenée à perdurer sous diverses formes. Dans la seconde partie, les pratiques contemporaines d'exploitation des navires sont identifiées et analysées : l'affréteur et le transporteur, les sociétés de shipmanagement, l'État- armateur, les armateurs unis dans un consortium, l'armateur dans la chaîne de transport constituent autant de facettes de la profession actuelle, caractérisée par sa forte capacité d'adaptation et d'innovation. De ce fait, l'auteur préfère présenter une étude serrée des différentes acceptions de la notion juridique d'armateur plutôt que donner une nouvelle définition de celle-ci. Docteur en droit, Isabelle Corbier est avocate au Barreau de Paris. La collection « Les grandes thèses du droit français » répond à un constat : nos facultés de droit sont à l'origine de nombreuses thèses d'un grand intérêt scientifique, mais malheureusement trop peu sont publiées. Nous voulons permettre aux meilleures thèses soutenues dans les disciplines juridiques d'être connues non seulement des universitaires, mais aussi des praticiens, et ce en France comme à l'étranger. Nous savons que la science juridique française mérite cet effort de promotion. Sans donner un caractère d'exclusivité à cette dimension, nous avons le souci d'inscrire cette collection dans le champ des transformations du Droit à l'époque contemporaine dont le droit communautaire constitue une donnée particulièrement importante.
