Book The Public Law Private Law Divide

Download or read book The Public Law Private Law Divide written by Mark R Freedland and published by Bloomsbury Publishing. This book was released on 2006-03-01 with total page 269 pages. Available in PDF, EPUB and Kindle. Book excerpt: The contributions brought together in this book derive from joint seminars, held by scholars between colleagues from the University of Oxford and the University of Paris II. Their starting point is the original divergence between the two jurisdictions, with the initial rejection of the public-private divide in English Law, but on the other hand its total acceptance as natural in French Law. Then, they go on to demonstrate that the two systems have converged, the British one towards a certain degree of acceptance of the division, the French one towards a growing questioning of it. However this is not the only part of the story, since both visions are now commonly coloured and affected by European Law and by globalisation, which introduces new tensions into our legal understanding of what is "public" and what is "private".

Book The OECD Convention on Bribery

    Book Details:
  • Author : Mark Pieth
  • Publisher : Cambridge University Press
  • Release : 2007-03-01
  • ISBN : 1139462946
  • Pages : 507 pages

Download or read book The OECD Convention on Bribery written by Mark Pieth and published by Cambridge University Press. This book was released on 2007-03-01 with total page 507 pages. Available in PDF, EPUB and Kindle. Book excerpt: The OECD Convention is the first major international treaty specifically to address 'supply-side bribery' by sanctioning the briber. The OECD Convention establishes an international standard for compliance with anti-corruption rules by 36 countries, including the 30 OECD members and six non-member countries, with the leading OECD exporting countries receiving particular attention. This book is an article-by-article commentary which gives particular attention to the results of the OECD monitoring process as applied to state implementation. Companies in particular are at ever greater risk of legal and 'reputational' damage resulting from failure to comply with the anti-corruption standards set inter alia, by the OECD Convention. This book provides them with comprehensive guidance on the OECD standards. The commentary also constitutes a significant work of comparative criminal law. It is written and edited by persons who include experts involved in development of the Convention standards as well as academics and legal practitioners.

Book Delegation of Powers in the EU Legal System

Download or read book Delegation of Powers in the EU Legal System written by Annalisa Volpato and published by Routledge. This book was released on 2022-03-29 with total page 327 pages. Available in PDF, EPUB and Kindle. Book excerpt: The majority of rules adopted at the EU level are not issued by democratically elected institutions, but rather by administrative bodies which are empowered to exercise rule-making powers by legislative acts. This book analyses the legal mechanism through which these powers are conferred on the most relevant bodies in the EU institutional landscape, namely the European Commission, the Council, the ECB and EU agencies, and the democratic controls in place to limit and oversee the exercise of these powers. Providing an overarching perspective of the delegation of powers, this book reflects on the notion of delegation and on the commonalities between the different forms of delegation identified. It focuses on the legal requirements and limits for the delegating act, the procedures for the exercise of such powers, the position of the acts in the hierarchy of norms, and their judicial review. Overcoming the fragmentation which characterized the development of the different forms of delegation in the EU, this analysis provides a clear, structured, and coherent picture of the legal framework for the delegation of powers in the light of the constitutional principles of this legal system. Academics and practitioners will equally appreciate this highly accessible addition to the current debate in legal scholarship of the delegation of powers in the EU, as well as its explanations on comitology and the empowerment of EU agencies.

Book La contractualisation dans les syst mes de sant

Download or read book La contractualisation dans les syst mes de sant written by Jean Perrot and published by KARTHALA Editions. This book was released on 2005 with total page 612 pages. Available in PDF, EPUB and Kindle.

Download or read book Yearbook of the European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment Annuaire de la convention europ enne pour la pr vention de la torture et des peines ou traitements inhumains ou d gradants written by Council of Europe/Conseil de l'Europe and published by BRILL. This book was released on 2018-11-01 with total page 2325 pages. Available in PDF, EPUB and Kindle. Book excerpt: The European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment was adopted by the Committee of Ministers of the Council of Europe in June 1987. It entered into force in February 1989 and all 47 member States are Parties to the Convention. The Convention has already established itself as an important human rights instrument. Its approach is quite different from that of the European Convention on Human Rights. Whereas the ECHR provides a remedy for particular human rights violations after the event, the Convention for the Prevention of Torture (ECPT) seeks to prevent human rights violations, through a system of visits to places of detention. The Convention is intended to be an integrated part of the Council of Europe system for the protection of human rights, placing a proactive non-judicial mechanism alongside the reactive judicial mechanism established under the ECHR. The Yearbook of the European Convention for the Prevention of Torture offers an essential annual overview of developments in relation to the ECPT. Part One contains general information. Part Two is about the European Committee for the prevention of torture and inhuman or degrading treatment or punishment (CPT). Part Three is a general report on the activities of the European Committee for the prevention of torture and inhuman or degrading treatment or punishment. Part Four contains reports on visits by the European Committee for the prevention of torture and inhuman or degrading treatment or punishment and responses of governments. Bilingual: English and French; 2-volume set.
