On pourrait d'un coté interpréter l'époque actuelle comme étant période de transition. Une transition causée par le déplacement du pouvoir étatique d'une proportion historique. La mondialisation retirait de l'État, depuis longtemps la forme d'organisation politique incontestablement dominante, de son autorité en transférant de ses fonctions habituelles aux auteures trans- et inter-étatique. Parmi ces acteurs surtout, et dans ce qui suit focalisés, les organisations internationales (OI), les organisations non-gouvernementales transnationales (ONG) et les entreprises transnationales (ET). En revanche, les sceptiques de ce développement constatent que les États nation maintiennent énergiquement leur autorité dans plusieurs domaines principales du gouvernement. Et cela à bon escient, comme sur la scène internationale ce sont seuls les États qui possèdent la légitimité de médiatiser leurs populations et d'établir un encadrement du droit obligeant. Selon la perception moderne, un gouvernement, soit nationale soit internationale, n'est légitime qu'il remplisse les conditions de la responsabilité et de la transparence. Voilà le problème de la régence d'une multitude des acteurs différents. Le sujet de cet essai est donc la souveraineté étatique de fait et fonctionnellement contesté par les effets politiques de la mondialisation. Ce premier doit, dans ce qui suit, être défini comme : L'autorité suprême de l'État sur son territoire national (souveraineté interne) et dans l'ordre international (souveraineté externe), où il n'est limité que par ses propres engagements. Les questions qui se posent pour cet Écrit sont les suivantes : 1. Est-ce que l'État nation est un modèle d’organisation humaine obsolète, dépassé par des acteurs inter- et transnationales qui sont mieux capable de remplir ses anciennes fonctions sur une planète d'interdépendances mondiales? 2. Est-ce que la mondialisation signe-t-elle sur le temps long la fin de l'État nation?
