Ces initiatives - la Charte de l'Atlantique, la Déclaraiton de Philadelphie, la Déclaration universelle des droits de l'homme, et d'autres de même portée - influenceront l'après-guerre d'une manière décisive. Par la suite, on mit sur pied une panoplie d'institutions à caractère humanitaire et économique, autour d'un pôle central, l'Organisation des Nations unies (ONU). Jamais ne voulait-on revivre l'expérience tragique des années 1929-1945. Cependant, l'après-guerre émergea dans une certaine dualité entre la prépondérance des Etats-Unis d'Amérique et les institutions de l'ONU. En outre, cette divergence économique se double d'une réalité bouleversante, une confrontation militaire Est-Ouest en temps de paix, qu'on surnomma la Guerre froide. Le monde de l'après-guerre fut également la scène d'un mouvement grandissant de décolonisation à partir de 1947, année où l'Inde et le Pakistan obtinrent leur indépendance de la Grande-Bretagne. En 1989, après plus d'un demi-siècle de tension constante, deux signaux diamétralement opposés provinrent du bloc sino-soviétique : le massacre de la place Tien Anmen à Beijing pendant l'été et la chute du mur de Berlin à l'automne. Dans cette nouvelle conjoncture, croyait-on, le visage de l'ONU changerait et les institutions de Bretton Woods deviendraient enfin vraiment universelles. Curieusementt, pendant cette période de consensus sur l'économie de marché qui débute avec les années 1990, on commence à se poser de plus en plus de questions au sujet du Fonds monétaire international, de la Banque mondiale et de l'Organisation mondiale du commerce. Par extension, on remet de plus en plus en question le nouvel ordre mondial sous toutes ses formes. En ce XXIe siècle, nous nous trouvons dans un tourbillon de changements, qui les auteurs de cet ouvrage tentent de clarifier à l'aide de diverses hypothèses générales. Par leurs origines, leurs spécialisations et leurs expériences diverses, ainsi que par les sujets multiples qu'ils abordent, ces auteurs nous proposent un remue-méninges d'un niveau réellement mondial.

If the UN is put in charge of a territory, is it bound by human rights law? Does that body of law apply to private security contractors who use torture to achieve their goals? Does the right to freedom of speech apply in a private shopping mall which has become the modern-day town centre? Under traditional approaches to human rights, non-State actors are beyond the direct reach of international human rights law. They cannot be parties to the relevant treaties and so they are only bound to the extent that obligations accepted by States can be applied to them by governments. The result is that entities including Non-Governmental Organizations, international organizations such as the UN and the IMF, private security contractors, and transnational corporations, along with many others, are generally considered not to be bound directly by human rights law. This situation threatens to make a mockery of much of the international system of accountability for human rights violations. As privatization, outsourcing, and downsizing place ever more public or governmental functions into the hands of private actors, the human rights regime must adapt if it is to maintain its relevance. The contributors to this volume examine the different approaches that might be taken in order to ensure some degree of accountability. Making space in the legal regime to take account of the role of non-State actors is one of the biggest and most critical challenges facing international law today.
