Book excerpt: La sospensione del processo per messa alla prova dell’imputato adulto, introdotta dalla l. 28 aprile 2014, n. 67, è un istituto complesso e proteiforme. La scelta del legislatore di attribuire alla messa alla prova una doppia natura, causa di estinzione del reato e procedimento speciale, ha condotto alla redazione di disposizioni collocate sia nel Codice penale sia in quello di rito. Il meccanismo di diversion consente all’imputato di allontanarsi dal processo ordinario in modo condizionato, fuoriuscendone definitivamente, qualora la prova abbia esito positivo, dopo aver percorso un binario parallelo rappresentato da un vero e proprio esperimento trattamentale. La sospensione del processo per messa alla prova infrange la sequenza tra reato e pena. Ne derivano sfide interpretative di non poca misura: alcune possono essere affrontate a livello pretorio, altre necessitano delle pronunce della Consulta e altre ancora sembrano esigere interventi legislativi ulteriori. La monografia La messa alla prova dell’imputato adulto. Analisi e prospettive di un modello processuale diverso ha ad oggetto lo studio della disciplina che regola l’istituto, con particolare attenzione agli aspetti processuali, senza tralasciare le questioni di diritto sostanziale, sia pure limitatamente ai profili essenziali dell’economia del lavoro.

U. il 2 maggio 2014, n. 100) e illustra gli aspetti fondamentali e procedurali del nuovo istituto della messa alla prova per gli imputati maggiorenni. Come è noto, questa misura era prevista solo per i minorenni dall’art. 28 del d.P.R. n. 448 del 1988 e, vista la forte affinità che caratterizza la messa alla prova in questione, si utilizzeranno, nella misura in cui ciò sia possibile, gli approdi ermeneutici elaborati dalla Cassazione essendo gli istituti della sospensione del processo con messa alla prova e l’affidamento in prova ai servizi sociali ispirati agli stessi «criteri generali comuni». In primo luogo, è stata esaminata la messa alla prova sotto il profilo sostanziale specificando i presupposti per poter applicare la suddetta misura. In secondo luogo, è stato trattato l’aspetto procedurale quindi il modo in cui deve essere formulata la richiesta di essere ammesso alla prova.
