La libre circulation des personnes touche tout le problème de l'immigration, des migrations non maîtrisées, du contrôle des frontières, etc. Tandis que le thème du droit d'asile soulève des questions sur l'harmonisation des politiques d'asile, leur caractère restrictif ou non, leur impact sur les dispositions de la Convention de Genève de 1951. Les auteurs développent d'abord la notion de libre circulation des personnes en droit européen tant sur le plan matériel qu'institutionnel (espaces de libre circulation, traités de Schengen et de Maastricht). Ils présentent également des concepts de base du droit des réfugiés (asile, Convention de Genève, etc.) avant d'aborder le coeur de leur étude. Celui-ci consiste en la confrontation du mécanisme de détermination de l'Etat responsable de l'examen d'une demande d'asile prévu dans les conventions de Schengen et de Dublin avec les dispositions de la Convention de Genève de 1951. Ils examinent ainsi les convergences et divergences des traités en question, de même que leur compatibilité.
