Book excerpt: The Second Spanish Republic (1931-36) was the only new liberal democratic regime to emerge in Europe during the 1930s. Historians, however, have focused primarily on the Civil War of 1936-39 that followed, devoting much less attention to the parliamentary regime that preceded it. This book deals with the history and failure of the democratic polity in Spain through a detailed examination of the initiatives of its president, Niceto Alcala Zamora. As civil servant, lawyer, politician and writer, by 1931 he had become one of the most successful men of Spain. He played the leading role in the downfall of the monarchy and the inauguration of the Republic, which he served for eight months as initial prime minister and then as the first president. Stanley Payne's study argues that the failure of the Republic was not inevitable but depended on the policy choices of its president and the key party leaders. Alcala Zamora's professed goal was to center the Republic, stabilizing the new regime while avoiding extremes, but he failed altogether in this project. The Constitution of 1931 stipulated the double responsibility of parliamentary government both to the president and to a voting majority. Though Alcala Zamora resisted strong efforts from the left to cancel the results of the first fully democratic elections in 1933, he subsequently used his powers recklessly, making and unmaking governments at will, refusing to permit normal functioning of parliament. This first critical scholarly account of the presidency of Alcala Zamora casts new light on the failure of democracy in interwar Europe and on the origins of the Spanish Civil War.

Taking place at the beginning of Spain’s Second Republic, those parliamentary deliberations brought about significant novelties in the political vocabulary. Concepts such as democracy, sovereignty, reform, revolution, and freedom, among others, were re-signified. This study investigates the conceptual contributions made by Spanish MPs in the course of the constitutional debate of 1931 by assuming, as a research approach, an interdisciplinary stance combining conceptual history, political theory, and parliamentary constitutional history. By doing so, it selects five determining issues: the pervasive discussion about two competing meanings of a democratic state; the rhetorical uses of reform and revolution; conceptual controversies about religious freedom; the disputed idea of property rights; and the functions of parliament and the president of the republic in a semi-presidential regime. The constitutional debate was largely inspired by interwar European constitutionalism which constituent representatives used to update the Spanish constitutional tradition. With that goal in mind, this book is aimed at undergraduate and graduate students and scholars working in the fields of conceptual history, political philosophy, parliamentary history, European political history, and European constitutionalism. Bertrana's novels reveal a unique interest in non-Western cultures and lifestyles and her work undertakes controversial topics and socio-cultural issues, while she observes and draws special attention to the situation of women in different circumstances and cultural geographies. This book is therefore anchored on interpretive and theoretical parameters that intersect with consideration of gender, such as travel-and-gender and war-and-gender. Roig uses the work of feminists such as Simone De Beauvoir, Shulamith Firestone, Jelke Boesten, Margaret and Patrice Higonnet, Michelle Zimbalist Rosaldo and Julia Kristeva to help assess Bertrana's engagement with gender and socio-political issues. This approach is particularly well suited for a writer like Bertrana, a Catalan and Republican intellectual woman forced into self-exile during the Spanish Civil War and the dictatorship of Francisco Franco. Book excerpt: This book discusses civil litigation at the supreme courts of nine jurisdictions – Argentina, Austria, Croatia, England and Wales, France, Germany, Italy, Spain and the United States – and focuses on the available instruments used to keep the caseload of these courts within acceptable limits. Such instruments are necessary in order to allow supreme courts to fulfil their main duties, that is, the administration of justice in individual cases (private function) and providing for the uniformity and development of the law within their respective jurisdictions (public function). If the number of cases at the supreme court level is too high, the result is undue delays, which are mainly problematic with regard to the private function. It may also put the quality of the court’s judgments under pressure, which can affect its public and private function alike. Thus, measures aimed at avoiding excessive caseloads need to take both functions into account. Increasing the capacity of the court to handle larger numbers of cases may result in the court being unable to adequately fulfil its public function, since large numbers of court decisions make it difficult to guarantee the uniformity of the law and its development. Therefore, a balanced approach is needed to safeguard capacity and quality. As shown by the contributions gathered here, the nature of reform in this area is not the same everywhere. There are a variety of reasons for this heterogeneity, ranging from different understandings of the caseload problem itself, local conceptions regarding the purpose of the Supreme Court, and strong entitlements concerning the right to appeal to budgetary restrictions and extremely rigid legislation. The book also shows that the implementation of similar solutions to case overload, such as access filters, may have different effects in different jurisdictions. The conclusion might well be that the problem of overburdened courts is multifactorial and context-dependent, and that easy, one-size-fits-all solutions are hard to find and perhaps even harder to implement.

Book excerpt: In Spain, the five-year period following the proclamation of the Republic in April 1931 was marked by physical assaults upon the property and public ritual of the Spanish Catholic Church. These attacks were generally carried out by rural and urban anticlerical workers who were frustrated by the Republic's practical inability to tackle the Church's vast power. On July 17/18, 1936, a right-wing military rebellion divided Spain geographically, provoking the radical fragmentation of power in the territory which remained under Republican authority. The coup marked the beginning of a conflict which developed into a full-scale civil war. Anticlerical protagonists, with the reconfigured structure of political opportunities working in their favor, participated in an unprecedented wave of iconoclasm and violence against the clergy. During the first six months of the conflict, innumerable religious buildings were destroyed and almost 7,000 religious personnel were killed. To date, scholarly interpretations of these violent acts were linked to irrationality, criminality, and primitiveness. However, the reasons for these outbursts are more complex and deep-rooted: Spanish popular anticlericalism was undergoing a radical process of reconfiguration during the first three decades of the 20th century. During a period of rapid social, cultural, and political change, anticlerical acts took on new - explicitly political - meanings, becoming both a catalyst and a symptom of social change. After July 17/18, 1936, anticlerical violence became a constructive force for many of its protagonists: an instrument with which to build a new society. This book explores the motives, mentalities, and collective identities of the groups involved in anticlericalism, during the pre-war Spanish Second Republic and the Spanish Civil War. It will be is essential reading for all those interested in 20th-century Spanish history.

In concentrating on the Partido Socialista Obrero Espafiol (PSOE), the major organised party of the left prior to the Civil War, the study seeks to achieve two main aims: first, to attempt to isolate the political, social and intellectual factors which led to a particularly distorted version of Marxism which became established in Spain at the end of the nineteenth century; and second, to demonstrate how this particular conception of Marxism had a crucial negative impact on the political formulations and fortunes of the PSOE between 1879 and 1936. The central argument of the book is that the significance of Spanish Marxism lay precisely in its poverty, since it was this 'decaffeinated' version of the theory which set the parameters within which the PSOE formulated its strategy for socialism.
