Resulta innegable que, en momentos y aspectos diferentes, la sociedad moderna ha experimentado profundos desarrollos en las ciencias, la economía y la política, lo que hace necesario enfrentarla a diferentes procesos de fundamentación y crítica. La Filosofía del Derecho no podía quedar al margen de esta continua revolución: bien puede decirse que, si no motor de ella, ha sido su coprotagonista. Debido a este continuo juego de criticar lo antiguo y fundamentar lo nuevo —hoy acentuado por la velocidad con que todo sucede y repercute a nivel global— nos encontramos en la actualidad frente a una doble empresa teórica. Por un lado, a la difícil defensa de las propuestas y reivindicaciones vinculadas con las concepciones del Derecho típicas del positivismo jurídico. Por otro, a la formulación de estrategias que, siendo críticas con esta teoría, tratan en consecuencia de elaborar nuevas propuestas teóricas dirigidas a comprender mejor una realidad en continuo cambio y deseosa de una aproximación diferente. Postpositivismo es el término que en mayor medida sirve para explicar esta nueva perspectiva. Esta colección se propone contribuir a la reflexión filosófico-jurídica contemporánea a través de la publicación de las aportaciones relevantes del debate, prestando especial atención a las dimensiones más novedosas del mismo. Book excerpt: La posición central que ocupan la política y el discurso político en la discusión teórica moderna ha sido sintetizada así: Virtualmente, toda la teoría jurídica contemporánea descansa sobre una distinción entre el razonamiento jurídico y la política. El análisis y razonamiento jurídico, en un lado, y el argumento político o la filosofía, en otro, son pensados como prácticas discursivas reconociblemente distintas. Sin embargo, la ausencia o la presencia de cualquier conexión general entre el derecho y la política y la manera como esto ha sido expresado en la teoría jurídica, obviamente, no es simplemente un fenómeno reciente. Nicolás de Maquiavelo y Thomas Hobbes sobresalen claramente por sus tempranos, lúcidos y profundos análisis de los asuntos sobre derecho y política en la temprana modernidad. Desde el propio nacimiento del Estado-nación, y especialmente después de su transformación en el Estado de bienestar moderno, ha habido una especial atención en explicar la relación entre los fenómenos jurídicos y políticos. Este interés teórico tiene sus raíces en el hecho de que, tal como lo anotó Jürgen Habermas, la propia "construcción del derecho y el poder político caracteriza la transición de sociedades organizadas con base en el parentesco con aquellas tempranas sociedades organizadas ya alrededor de los Estados"

Desde un principio me di cuenta al instante de lo extremadamente disímiles que eran las posiciones de los académicos del derecho en lo que se refiere a estas relaciones. Esto libro no pretende ser más que una herramienta descriptiva tanto para teóricos como para académicos del derecho en general, con la cual pueden organizar varias teorías jurídicas contemporáneas en tipos ideales, que permiten mostrar las relaciones entre el derecho y la política. De ningún modo pretende ser la última palabra en este asunto; muy por el contrario, este trabajo simplemente apunta a proponer un punto de partida descriptivo desde donde se puede iniciar a considerar y a evaluar críticamente las teorías jurídicas contemporáneas y sus ideas en lo referente al derecho y la política.

It provides a single, dedicated space for a range of established European scholars to engage with the influential work of this Austrian jurist, legal philosopher, and political philosopher. The introduction provides a thematization of the Kelsenian notion of law as a legal science. Divided into six parts, the chapter contributions feature distinct levels of analysis. Overall, the structure of the book provides a sustained reflection upon central aspects of Kelsenian legal science and the nature of law. Parts one and two examine the validity of the project of Kelsenian legal science with particular reference to the social fact thesis, the notion of a science of positive law and the specifically Kelsenian concept of the basic norm (Grundnorm). The next three parts engage in a critical analysis of the relationship of Kelsenian legal science to constitutionalism, practical reason, and human rights. The last part involves an examination of the continued pertinence of Kelsenian legal science as a theory of the nature of law with a particular focus upon contemporary non-positivist theories of law. In this sense, national legal systems expressed through national languages organize the Law based on their own understanding of reality. International Law becomes, in this context, the meeting point where different legal cultures and different views of world intersect. The diversity of languages and legal systems can enrich the possibilities of understanding and developing international law, but it can also represent an instability and unsafety factor to the international scenario. This multilegal-system and multilingual scenario adds to the complexity of international law and poses new challenges. One of them is legal translation, which is a field of knowledge and professional skill that has not been the subject of theoretical thinking on the part of legal scholars. How to negotiate, draft or interpret an international treaty that mirrors what the parties, – who belong to different legal cultures and who, on many occasions, speak different mother tongues – ,want or wanted to say? By analyzing the decision-making process and the legal discourse adopted by the WTO’s Appellate Body, this book highlights the active role of language in diplomatic negotiations and in interpreting international law. These theories significantly advance the case for coherentism in law. Nonetheless, there remain a number of problems in the coherence theory in law. This ambitious new work makes the first concerted attempt to develop a coherence-based theory of legal reasoning, and in so doing addresses, or at least mitigates these problems. The book is organized in three parts. The first part provides a critical analysis of the main coherentist approaches to both normative and factual reasoning in law. The second part investigates the coherence theory in a number of fields that are relevant to law: coherence theories of epistemic justification, coherentist approaches to belief revision and theory-choice in science, coherence theories of practical and moral reasoning and coherence-based approaches to discourse interpretation. Taking this interdisciplinary analysis as a starting point, the third part develops a coherence-based model of legal reasoning. While this model builds upon the standard theory of legal reasoning, it also leads to rethinking some of the basic assumptions that characterize this theory, and suggests some lines along which it may be further developed. Thus, ultimately, the book not only improves upon the current state of coherence theory in law, but also contributes to the larger debate about how to articulate a theory of legal reasoning that results in better decision-making.
