They were crafted by merchants with the support of numerous personnel on the medieval marketplace: notaries, innkeepers, brokers, transporters, and subordinate personnel of the merchant's entourage. This study introduces the reader to the challenges of trade in the Mediterranean world and to specific market conditions in the Mediterranean French town of Montpellier. A case study of the business of the Cabanis merchants permits an in-depth examination of the facilitation of trade by intermediaries whose activities are traced in the discovery phase of arranging a deal and in its closing and execution. Medieval business practice involved multiple layers of personnel. The complexities of medieval trade are revealed in the new emphasis given to those who assisted merchants in their commercial endeavors.

A tal efecto, se parte del previo análisis de la configuración constitucional del derecho de propiedad, que posibilita la cabal comprensión, desde su misma base, del entero sistema urbanístico, así como de buena parte de la problemática que actualmente plantea la propiedad del suelo, como una más de las manifestaciones que la propiedad privada presenta por razón de su peculiar objeto. El estudio de cuestiones capitales en el régimen constitucional de este derecho, tales como su propio concepto, su función social como elemento estructural del derecho que opera delimitando su contenido, o los mecanismos constitucionalmente diseñados para su protección, tanto en el plano material como en el plano formal, permiten extraer conclusiones relativas a cuestiones propiamente urbanísticas. Así, son objeto de análisis, entre otras, cuestiones como la clasificación del suelo, inevitablemente ligada al concepto de función social, el ius aedificandi y su posible inherencia al contenido del derecho de propiedad del suelo, la valoración del suelo, la posición del propietario ante la obra urbanizadora, la configuración y articulación de los mecanismos de participación de la comunidad en las plusvalías generadas por la acción urbanística de los entes públicos, o la expropiación por incumplimiento de la función social de la propiedad.
