Book excerpt: L'énergie nucléaire est apparue à la fois comme un élément de destruction et de progrès pour l'humanité. Afin de préserver l'aspect bénéfique de cette découverte, l'A.I.E.A., créée en 1957, est investie de plusieurs fonctions dont celle de contrôler l'utilisation pacifique de l'énergie nucléaire. A cet effet, elle a établi un système de contrôle ayant pour but de vérifier l'application du droit international, c'est-à-dire le respect, par les états concernés, de la norme juridique (définie par différents instruments juridiques tels que le statut de l'A.I.E.A., les traités de Tlatelolco et Rarotonga, T.N.P.), à savoir le non-détournement de matière nucléaire à des fins militaires. Afin de réaliser cette finalité, l'objectif immédiat du contrôle est d'amener les états à accomplir leurs activités pacifiques en pleine transparence. Cependant, à l'origine, ce système de contrôle revêtait un caractère limité, ne s'appliquant qu'en fonction de l'aide consentie par l'agence. Seul un double mouvement de généralisation, tendant vers une universalisation du système, et de renforcement a abouti à un progrès certain dans la réalisation de cet objectif immédiat, permettant ainsi au contrôle de s'assurer du respect du non-détournement des matières nucléaires à des fins militaires. L'examen du domaine du contrôle de l'A.I.E.A., et de sa mise en oeuvre révèle quelques imperfections remettant en cause la réalisation de ce but ultime. Mais les mesures adoptées (contrôle sur pièces et sur place), et les suites prévues (notamment par l'adoption de sanctions), font que ce contrôle vise à dissuader et à prévenir les violations de la norme, et donc à garantir son respect. L'ensemble de cette étude permet de conclure que la fonction de contrôle de l'A.I.E.A. revêt un caractère objectif de mise au service de la communauté internationale. En effet, celle-ci procède bien à un contrôle objectif puisque ce dernier vise à l'application du droit. Cette nature objective se voit renforcer par la présence d'un lien subjectif spécifique au système de l'A.I.E.A (la conclusion d'un accord de garanties liant l'état à l'agence), mettant ainsi en confrontation l'intérêt particulier (celui de l'état) à l'intérêt général. Le contrôle, exercé par une organisation internationale est donc un moyen efficace d'application de la norme internationale.
