Using a large data set on political financing in more than 40 democracies, the book offers an unprecedented comparative study of the features of party subsidies and their effects on campaign finance practices, party systems and party organisations. The book also provides a detailed empirical account of campaign finance in two of Latin America's most consolidated democracies. Drawing upon extensive archival work and interviews, this work sheds light on largely hidden aspects of politics in the developing world and questions widespread beliefs about political finance, such as the rapid increase of campaign costs and the crucial role of television in this trend.

This book addresses the scope and limits of judicial control at the national level, i.e. the control of public authorities, and at the supranational level, i.e. the control of States. It explores the risk of judicial review leading to judicial activism that can threaten the principle of the separation of powers or the legitimate exercise of state powers. It analyzes how national and supranational legal systems have embodied certain mechanisms, such as the principles of reasonableness, proportionality, deference and margin of appreciation, as well as the horizontal effects of human rights that help to determine how far a judge can go. Taking a theoretical and comparative view, the book first examines the conceptual bases of the various control systems and then studies the models, structural elements, and functions of the control instruments in selected countries and regions. It uses country and regional reports as the basis for the comparison of the convergences and divergences of the implementation of control in certain countries of Europe, Latin America, and Africa. The book’s theoretical reflections and comparative investigations provide answers to important questions, such as whether or not there are nascent universal principles concerning the control of public power, how strong the impact of particular legal traditions is, and to what extent international law concepts have had harmonizing and strengthening effects on internal public-power control.

This global threat knows no boundaries, and is evident across all continents from huge corporate campaign donations in the United States and drug money seeping into politics in Latin America, to corruption scandals throughout Asia and Europe. Attempts to tackle these challenges through political finance laws and regulations are often undermined by a lack of political will or capacity, as well as poorly designed and enforced measures. This Handbook addresses the problems of money in politics by analysing political finance regulations around the world and providing guidance for reform. The chapters are divided by region; each assesses the current state of regulations in relation to its challenges and offers a series of recommendations to tackle the identified shortcomings. But while organized crime may not get the headlines it once did in North America, the resurgence of such criminal activity in Latin America, and in some European nations, has grabbed the public’s attention. In Dangerous Liaisons noted scholars describe and analyze the role of organized crime in the financing of politics in selected democracies in Latin America (Argentina, Brazil, Colombia, Costa Rica, and Mexico) and in Europe (Bulgaria and Italy). The book seeks to unravel the myths that have developed around crime in these locales, while providing facts and informing the debate on how organized crime corrupts democratic institutions, especially in relation to the funding of political parties and their activities. It discusses the voting unity and ballot systems that allow voters to identify an agent, and describes the degree to which those agents have been flexible with regards to the formation of policy coalitions. It also shows that the US parties have exhibited higher levels of unity but less flexibility in recent years, and thus contrast the prevailing pattern in Latin America. The book focuses its explanation for the patterns on the role of candidate nominations, other aspects of the electoral system and the legislators' ideological alignments.

The first part of the volume reviews theoretical motivations behind the growing disdain for the political party. In surveying the parties' lengthy attempt to gain legitimacy, particular attention is devoted to the cultural and political conditions which led to their emergence on the ground' and then to their political and theoretical acceptance as the sole master in the chain of delegation. The second part traces the evolution of the party's organization and public confidence against the backdrop of the transition from industrial to post-industrial societies. The book suggests that, in the post-war period, parties shifted from a golden age of organizational development and positive reception by public opinion towards a more difficult relationship with society as it moved into post industrialism. Parties were unable to master societal change and thus moved towards the state to recover resources they were no longer able to extract from their constituencies. Parties have become richer and more powerful thanks to their interpenetration into the state, but they have paid' for their pervasive presence in society and the state with a declining legitimacy. Even if some changes have been introduced recently in party organizations to counteract their decline, they seem to have become ineffective; even worse, they have dampened democratic standing inside and outside parties, favouring plebiscitary tendencies. The party today is caught in a dramatic contradiction. It has become a sort of Leviathan with clay feet: very powerful thanks to the resources it gets from the state and to its control of the societal and state spheres, but very weak in terms of legitimacy and confidence in the eyes of the mass public. However, it is argued that there is still no alternative to the party. Democracy is still inextricably linked to the party system.

Since the election of Hugo Chávez as president of Venezuela in 1998, a sinister form of nationalistic authoritarianism has arisen at the expense of long-established democratic standards. During the past decade, the 1999 Venezuelan Constitution has been systematically attacked by all branches of the Chávez government, particularly by the Supreme Tribunal of Justice, which has legitimized the Chávez-ordered constitutional violations. The Chávez regime has purposely defrauded the Constitution and severely restricted representative government, all in the name of a supposedly participatory democracy controlled by a popularly supported central government. This volume illustrates how an authoritarian, nondemocratic government has been established in Venezuela.
