In the personalist approach of bioethics, the natural law tradition distinguishes the person from his or her acts. In the case of same-sex attractions, the Church teaches clearly that the inclination is not in itself sinful, and that persons with such attractions are deserving of respect and compassion in accord with their full human dignity. Nonetheless, same-sex acts are not natural or ordered. The Church strives to build bridges with the LGBT community by fostering a relationship of compassion, sensitivity, and mutual respect. However, real bridges also require honesty and openness to the truths that pertain to human sexuality, procreation, the family, and the education of future generation.

Most recent international conventions have placed much emphasis on the priority to be given to child protection rather than other personal interests. While no syntagmatic principle exists for a theoretical definition and boundary of religious freedoms and legal rules affecting Islamic kafala, it has become a prevailing interpretative canon which requires the scholar to aim for a proper understanding of the cultural identities and measures to safeguard individuals concerned. Book excerpt: This book centres on the ways in which the concept of imperativeness has found expression in private international law (PIL) and discusses “imperative norms”, and “imperativeness” as their intrinsic quality, examining the rules or principles that protect fundamental interests and/or the values of a state so as to require their application at any cost and without exceptions. Discussing imperative norms in PIL means referring to international public policy and overriding mandatory rules: in this book the origins, content, scope and effects of both these forms of imperativeness are analyzed in depth. This is a subject deserving further study, considering that very divergent opinions are still emerging within academia and case law regarding the differences between international public policy and overriding mandatory rules as well as with regard to their way of functioning. By using an approach mainly based on an analysis of the case law of the CJEU and of the courts of the various European countries, the book delves into the origin of imperativeness since Roman law, explains how imperative norms have evolved in the different conceptions of private international law, and clarifies the foundation of the differences between international public policy and overriding mandatory rules and how these concepts are used in EU Regulations on PIL (and in the practice related to these sources of law). Finally, the work discusses the influence of EU and public international law sources on the concept of imperativeness within the legal systems of European countries and whether a minimum content of imperativeness – mainly aimed at ensuring the protection of fundamental human rights in transnational relationships – between these countries has emerged. The book will prove an essential tool for academics with an interest in the analysis of these general concepts and practitioners having to deal with the functioning of imperative norms in litigation cases and in the drafting of international contracts. This book examines the protection of family life and family reunification within the framework of international conventions on human rights, family reunification and the protection of family life in the area of justice, the rights of family members of European citizens in the EU legislation and the case law; the rules set by the Directives 2004/38/EC and 2003/86/EC, the relationship between EU legislation on family reunification and the respect of national rules governing the entry and residence of migrants. An important part of this work is dedicated to the right of family reunification in the national law, namely to protect the family unit in Italy in accordance with the Consolidated immigration no. 296/98.

The earliest documentary evidence takes the form of letters from King Theodoric. For the Middle Ages the documentation is relatively fragmentary and sporadic. Later there is greater abundance of historical evidence, which portrays chiefly the destinies of the Jews in the Republic from the sixteenth century on, when the presence of the Jews became permanent and a regular community was established also in the capital.The historical records presented illustrate mainly the relationship between the government of the Genoese Republic and the Jews, the latter's economic activities and their communal and social life. Some of the detailed descriptions of the Jewish population in Genoa, their living conditions and occupations, allow for a close examination of the social conditions of this Northern Italian community. For a while Genoa became a haven of refuge for some of the exiles from Spain, including the historian Joseph Hacohen and members of the Abarbanel family. The volumes are provided with an extensive introduction, bibliography, glossary and indexes."

The Supreme Court's modern approach appears detached from and inconsistent with the underlying fundamental principles that ought to guide it, an approach that often leads to unfair and inefficient results. This book suggests the adoption of a judicial decision-making model that proceeds from principles and rules and treats these principles and rules as premises for developing consistent unitary theories to meet current social conditions. This model requires that judicial opinions be informed by a wide range of considerations, beginning with established legal standards - but also including the insights derived from deductive and inductive reasoning, the lessons learned from history and custom - and ending with an examination of the social and economic consequences of the decision. Under this model, the considerations taken to reach a specific result should be articulated through a process that considers various hypotheses, arguments, confutations, and confirmations, and they should be shared with the public.
