Merkl ofrece su visión respecto de la epistemología jurídica respondiendo preguntas como: ¿qué es el derecho?, ¿cómo identificarlo?, ¿de qué manera abordar su conocimiento? Preguntas fundamentales en los debates teórico-jurídicos sobre metodología del derecho. Es así como su trabajo da cuenta de los límites del derecho en tres direcciones. Primero, respecto de las distintas nociones de Estado y cómo se manifiesta su surgimiento o cambio; segundo, en lo referido a la explicación de las nociones de soberanía y constitución en el contexto de una estructura estatal; y tercero, en cuanto a considerar a las normas irregulares o inválidas dentro de su reconstrucción frente a las instituciones jurídicas que posibilitan su convalidación. Temáticas estas últimas que desde el siglo pasado hasta la actualidad se han posicionado como tópicos perennes de la teoría jurídica. La importancia histórica de estos textos radica en proporcionar al público hispanohablante los insumos necesarios para determinar cómo se ideó una primera reconstrucción teórica del carácter dinámico del derecho.

Book excerpt: What this book intends to do is to study three-dimensionalism (the distinction values-norms-facts) not in what could be called its historical dimension, but in its substantive aspect, as a “form” that, when applied to different legal themes, would add a “material content” to the three-dimensional theory. We can point out, as a study plan, the distinction between “three” perspectives: Those of the legal norm, of the legal order, and the legal relationship. Three-dimensionalism also appears in this work when one analyzes the “three” phases of the life of the law: The formation, the interpretation, and the application; and in the distinction between the “three” characteristics of the legal order: Fullness, coherence, and unity—the theory of legal validity, intended as legitimacy, as validity strictly speaking, or as effectiveness.

Book excerpt: A Deleuzian reading of Whitehead and a Whiteheadian reading of Deleuze open the possibility of a critical aesthetics of contemporary culture. In Without Criteria, Steven Shaviro proposes and explores a philosophical fantasy: imagine a world in which Alfred North Whitehead takes the place of Martin Heidegger. What if Whitehead, instead of Heidegger, had set the agenda for postmodern thought? Heidegger asks, “Why is there something, rather than nothing?” Whitehead asks, “How is it that there is always something new?” In a world where everything from popular music to DNA is being sampled and recombined, argues Shaviro, Whitehead's question is the truly urgent one. Without Criteria is Shaviro's experiment in rethinking postmodern theory, especially the theory of aesthetics, from a point of view that hearkens back to Whitehead rather than Heidegger. In working through the ideas of Whitehead and Deleuze, Shaviro also appeals to Kant, arguing that certain aspects of Kant's thought pave the way for the philosophical “constructivism” embraced by both Whitehead and Deleuze. Kant, Whitehead, and Deleuze are not commonly grouped together, but the juxtaposition of them in Without Criteria helps to shed light on a variety of issues that are of concern to contemporary art and media practices.
