Pourtant, le respect de la dignité peut être limité si l'intérêt général le nécessite, l'État veillant à ce que le respect de la dignité de tous soit garanti. À la fois principe à valeur constitutionnelle et composante de l'ordre public, la dignité humaine occupe une place centrale en droit français. Aujourd'hui, les requérants l'invoquent au soutien de leurs multiples requêtes : mesures privatives de liberté, droit d'asile, droit à la vie ou à la mort, etc. Cette omniprésence force le juge à mettre en balance dignités individuelle et universelle. Ce double visage est en réalité l'analogue des deux objectifs de l'État de droit : la préservation des libertés et la protection de l'intérêt général. La reconnaissance d'une atteinte portée à la dignité justifie des mesures de police administrative, et certains craignent que la marge d'appréciation laissée au juge lui permette de décider ce qui est moral ou non.

Book excerpt: Inséré par les juges constitutionnel et administratif dans le bloc de constitutionnalité et au sein de l'ordre public administratif, le principe de sauvegarde de la dignité de la personne humaine devient, à partir de 1994, une donnée essentielle du droit public français : il traduit un souci de protection juridique de l'humanité de l'homme, qui mobilise les juristes, mais également la classe politique et la société dans son ensemble. La difficile juridicisation du principe (en raison de sa valeur absolue) intervient notamment grâce à l'émergence d'un droit subjectif au respect pour chacun de sa dignité humaine. Mais ce principe particulier n'est pas toujours adapté à l'ordre juridique français : son champ d'application s'élargit de manière excessive, il devient un principe moralisateur, et sa portée est amoindrie. Afin d'harmoniser la sauvegarde de la dignité de la personne humaine avec le droit public français, il sera nécessaire de restreindre son domaine d'application d'un point de vue ratione materiae et personae, mais aussi de rechercher le point d'équilibre existant entre le principe et les libertés classiques du droit

De nombreux auteurs sont prompts à y voir aujourd'hui le fondement de tous les droits fondamentaux ou encore le principe cardinal de l'ordre juridique dans sa globalité : destinée paradoxale d'un principe qui, il y a peu encore, n'avait pas reçu de consécration explicite en droit positif français. Ce constat constitue le point de départ d'une réflexion sur les forces à l'œuvre dans la promotion d'un tel principe, méconnu sinon ignoré hier, célébré aujourd'hui comme tout à fait essentiel. Le présent ouvrage vise donc à analyser le processus de juridicisation qui a affecté le principe de dignité de la personne humaine, au moyen d'une confrontation le plus systématique possible entre les usages qu'en font les juges nationaux et la portée que lui confère la doctrine. Cette analyse produit des résultats étonnants par leur caractère démonstratif mettant en évidence une dimension massivement prescriptive du discours doctrinal sur ce sujet. Cette hypothèse interprétative est proposée au terme d'une recherche qui analyse de manière distincte le discours doctrinal (dans ses différentes versions constitutionnaliste, administrative, civiliste, de droit social...) et le discours juridictionnel (analysé à partir d'un corpus de 337 décisions de justice). Elle est par ailleurs enrichie par les contributions d'auteurs qui, à des titres divers (responsables associatifs, professionnels médicaux ou encore historiens, politistes, philosophes et juristes), ont à réfléchir sur et à manier le principe de dignité. L'ambition de cet ouvrage est à la fois d'attirer l'attention sur certaines caractéristiques et certains effets de la prescription doctrinale en général et sur la multiplicité des sens (et des évaluations) applicables à la notion de dignité en particulier.
