Un projet de "traité constitutionnel" a été élaboré par la "Convention sur l'avenir de l'Europe", qui s'est réunie à Bruxelles de février 2002 à juin 2003, sous la présidence de Valéry Giscard d'Estaing. Que dire de la dénomination (Constitution/Traité) donnée à ce texte? Quel en est le contenu? Quels en sont les enjeux? Quelle en est la portée? Cet ouvrage s'attache à répondre à ces questions, en proposant un bilan critique des travaux de la Convention. Ce bilan présente une double originalité. Il est dressé par des universitaires et des chercheurs travaillant dans deux pays qui ont, depuis l'origine, joué un rôle moteur dans la construction européenne: l'Allemagne et la France. En outre, il est établi par des spécialistes de trois disciplines: l'économie, le droit et la science politique. Cette association, inédite sur le sujet, offre un autre éclairage sur la question européenne, en ce qu'elle induit une "politisation" des questions institutionnelles. En effet, parler de la Constitution de l'Europe, c'est évoquer le défi majeur auquel l'Union est désormais confrontée: celui de faire coïncider, à l'échelle d'une Union élargie à 25 membres, gouvernementalité et principe démocratique dans un cadre institutionnel renouvelé. Il ne suffit pas de vouloir l'Europe, encore faut-il être en mesure de savoir quelle Europe nous voulons faire. Les spécialistes comme les citoyens intéressés trouveront ici matière à réflexion sur cet enjeu majeur.

Tous les Européens ont pu partager leurs idées sur une plateforme numérique multilingue innovante et participer à des panels de citoyens organisés au niveau national et européen. Avec plus de 5 millions de visiteurs sur la plateforme et plus de 700 000 participants, la conférence a réussi à créer un forum public permettant un débat ouvert, inclusif et transparent avec les citoyens autour d'une série de priorités et de défis clés. Ces contributions ont alimenté les séances plénières de la conférence.

Deux conditions ont été jugées essentielles au succès de la conférence: - veiller à ce que le plus grand nombre possible d'Européens puissent prendre part au débat et exprimer leurs idées, leurs souhaits, leurs préoccupations et leurs attentes vis-à-vis de l'Europe, et à ce que cet exercice ne soit pas réservé aux «cercles d'initiés habituels», c'est-à-dire aux organisations militantes, aux groupes de pression et aux mouvements familiers avec la vie de l'Union et qui en font déjà partie; veiller à ce que cette contribution publique fasse l'objet d'un suivi et ne finisse pas dans l'oubli, comme ce fut le cas lors d'exercices antérieurs dont l'ambition de départ était de rapprocher l'Union de ses citoyens. Ce séminaire intitulé «Connecter l'UE» aura pour objectif de contribuer à satisfaire à la première condition. Le CESE s'efforcera de faciliter une large participation de la société civile à la conférence. Il a été décidé que les trois tables rondes du séminaire porteraient sur trois des neuf thèmes principaux retenus pour les débats, à savoir: la santé; une économie plus forte, justice sociale et emploi; la liberté des médias comme condition indispensable de la démocratie en Europe.

Law has been one of the most thoroughly investigated aspects of the European integration process, and EU law has become a well-established academic discipline, with the emergence more recently of an impressive body of legal and political science literature on 'European law in context'. Yet this field has been dominated by an essentially judicial narrative, focused on the role of the European courts, underestimating in the process the multifaceted roles lawyers and law play in the EU polity, notably the roles they play beyond the litigation arena.
