Book excerpt: Lo studio prende in esame in modo sistematico il tema della convalidazione automatica del matrimonio, ossia di quell' istituto in forza del quale un vincolo matrimoniale si sana automaticamente, grazie al perseverare del consenso maritale una volta venuta meno la causa invalidante, senza che si richieda nel caso particolare l'intervento di una delle parti o dell'autorità della Chiesa. Lo scopo ultimo della dissertazione è verificare se una tale sanatoria automatica si ponga in contrasto con il principio dell'insostituibilità del consenso. L'originalità del lavoro consiste nel trattare il tema aprendosi al confronto con l'ordinamento civile, in particolare quello italiano. La presente ricerca mette in evidenza anzitutto come non vi sia incompatibilità né preclusione da parte dell'ordinamento canonico nei confronti della convalidazione automatica. Nello specifico, accettare un tale istituto nell' ambito matrimoniale, oltre a non scontrarsi con il principio di insostituibilità del consenso, in determinati casi ne diventa garante. Alla luce di tutte queste considerazioni, fatta salva la legittima esigenza di pubblicità, si ritiene possibile un ripensamento dell' attuale istituto matrimoniale della convalidazione al fine di garantire maggiormente il riconoscimento dovuto al consenso naturaliter sufficiens.
