Come sarà argomentato e dimostrato, la normativa vigente è più che idonea e richiede unicamente di essere rigorosamente applicata a partire da una lettura sistemica delle norme del processo, che devono trovare applicazione anche nello svolgimento di quella parte dell’istruzione probatoria che è la consulenza tecnica d’ufficio. Un altro nodo critico che sarà affrontato è quello degli Albi professionali, materia disciplinata dalle “Disposizioni per l’attuazione del codice di procedura civile e disposizioni transitorie”, con riferimento alla loro tenuta, al loro utilizzo (distribuzione degli incarichi), e alle sanzioni disciplinari. Si tratta del potere di accertamento del possesso dei requisiti che il professionista deve possedere e mantenere per potere essere iscritto in una data categoria di consulenti e della vigilanza sui consulenti tecnici che il Presidente del Tribunale deve attuare, potendo anche assumere iniziative disciplinari. L’intento di questo testo è quindi quello di delineare quali siano gli assi cartesiani del diritto nei cui ambiti e confini deve svolgersi l’attività del consulente del giudice e nel contempo di offrire agli operatori del diritto ed ai consulenti del Giudice uno strumento che non propone solo soluzioni precostituite, bensì uno stimolo a trovare soluzioni e prassi condivise.
