Available in PDF, EPUB and Kindle.

Book Latin American Constitutionalism 1810 2010

Download or read book Latin American Constitutionalism 1810 2010 written by Roberto Gargarella and published by Oxford University Press. This book was released on 2013-07-01 with total page 298 pages. Available in PDF, EPUB and Kindle. Book excerpt: Latin America possesses an enormously rich constitutional history, one that has only recently become the subject of scholarly inquiry. As noted legal theorist Roberto Gargarella contends, contemporary constitutional and political theory has a great deal to learn from this history, as Latin American constitutionalism has endured unique challenges that have not appeared in other regions. Such challenges include the emergence of egalitarian constitutions in inegalitarian contexts; deliberation over the value of "importing" foreign legal instruments; a long-standing exercise of socio-economic rights; issues of multiculturalism and indigenous rights; and substantial experience with "unbalanced" versions of the system of "checks and balances." Moreover, Latin American nations have endured numerous and frequent constitutional changes over the past two centuries. In this landmark book, Gargarella provides a broadly comparative history of Latin American constitutionalism, informed by constitutional theory. He organizes the book across four major historical periods of Latin American legal history, infusing this history with a discussion of the ideas of thinkers including Juan Bautista Alberdi, Francisco Bilbao, Simón Bolívar; Juan Egaña, José González Vigil, Victorino Lastarria, Juan Carlos Mariátegui, Juan Montalvo, José María Mora, Mariano Otero, Manuel Murillo Toro, José María Samper and Domingo Sarmiento. Written by one of the leading scholars in the field, this book is truly a milestone in the study of Latin American constitutionalism.

Available in PDF, EPUB and Kindle. Book excerpt: A key intermediary between courts and the public are the journalists who monitor the actions of justices and report their decisions, pronouncements, and proclivities. Justices and Journalists: The Global Perspective is the first volume of its kind - a comparative analysis of the relationship between supreme courts and the press who cover them. Understanding this relationship is critical in a digital media age when government transparency is increasingly demanded by the public and judicial actions are the subject of press and public scrutiny. Richard Davis and David Taras take a comparative look at how justices in countries around the world relate to the media, the interactive points between the courts and the press, the roles of television and the digital media, and the future of the relationship.

Book Diccionario de la Democracia

Download or read book Diccionario de la Democracia written by Patricio Marcos and published by Palibrio. This book was released on 2012-10 with total page 826 pages. Available in PDF, EPUB and Kindle.

Book Transformative Constitutionalism in Latin America

Download or read book Transformative Constitutionalism in Latin America written by Armin von Bogdandy and published by Oxford University Press. This book was released on 2017-07-21 with total page 513 pages. Available in PDF, EPUB and Kindle. Book excerpt: This ground-breaking collection of essays outlines and explains the unique development of Latin American jurisprudence. It introduces the idea of the Ius Constitutionale Commune en América Latina (ICCAL), an original Latin American path of transformative constitutionalism, to an Anglophone audience for the first time. It charts the key developments that have transformed the region and assesses the success of the constitutional projects that followed a period of authoritarian regimes in Latin America. Coined by scholars who have been documenting, conceptualizing, and comparing the development of Latin American public law for more than a decade, the term ICCAL encompasses themes that cross national borders and legal fields, taking in constitutional law, administrative law, general public international law, regional integration law, human rights, and investment law. Not only does this volume map the legal landscape, it also suggests measures to improve society via due legal process and a rights-based, supranational and regionally rooted constitutionalism. The editors contend that with the strengthening of democracy, the rule of law, and human rights, common problems such as the exclusion of wide sectors of the population from having a say in government, as well as corruption, hyper-presidentialism, and the weak normativity of the law can be combatted more effectively in future.

Book The Rule of Law in Nascent Democracies

Download or read book The Rule of Law in Nascent Democracies written by Rebecca Bill Chavez and published by Stanford University Press. This book was released on 2004 with total page 284 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explains how the rule of law emerges and how it survives in nascent democracies. The question of how nascent democracies construct and fortify the rule of law is fundamentally about power. By focusing on judicial autonomy, a key component of the rule of law, this book demonstrates that the fragmentation of political power is a necessary condition for the rule of law. In particular, it shows how party competition sets the stage for independent courts. Using case studies of Argentina at the national level and of two neighboring Argentine provinces, San Luis and Mendoza, this book also addresses patterns of power in the economic and societal realms. The distribution of economic resources among members of a divided elite fosters competitive politics and is therefore one path to the requisite political fragmentation. Where institutional power and economic power converge, a reform coalition of civil society actors can overcome monopolies in the political realm.

Book La construcci n de la democracia

Download or read book La construcci n de la democracia written by Luigi Ferrajoli and published by Trotta. This book was released on 2023-11-15 with total page 578 pages. Available in PDF, EPUB and Kindle.

Book excerpt: In this groundbreaking book, Arnold August explores Cuba's unique form of democracy, presenting a detailed and balanced analysis of Cuba's electoral process and the state's functioning between elections. By comparing them with practices in the U.S., Venezuela, Bolivia and Ecuador, August shows that people's participation in politics and society is not limited to a singular, U.S.- centric understanding of democracy. Through this deft analysis, August illustrates how the process of democratization in Cuba is continually in motion and argues that a greater understanding of different political systems teaches us to not be satisfied with either blanket condemnations or idealistic political illusions.
