The deeper question is how this shapes broader relations of power. By examining the relationship between law and gender as it manifests itself in the Mexican legal system, the thirteen essays in this volume show how law is produced by, but also perpetuates, unequal power relations. At the same time, however, authors show how law is often malleable and can provide spaces for negotiation and redress. The contributors (including political scientists, sociologists, geographers, anthropologists, and economists) explore these issues-not only in courts, police stations, and prisons, but also in rural organizations, indigenous communities, and families. By bringing new interdisciplinary perspectives to issues such as the quality of citizenship and the rule of law in present-day Mexico, this book raises important issues for research on the relationship between law and gender more widely.

Book excerpt: Too often in the history of Mexico, women have been portrayed as marginal figures rather than legitimate participants in social processes. As the twentieth century draws to a close, Mexican women of the countryside can be seen as true historical actors: mothers and heads of households, factory and field workers, community activists, artisans, and merchants. In this new book, thirteen contributions by historians, anthropologists, and sociologists—from Mexico as well as the United States—elucidate the roles of women and changing gender relations in Mexico as rural families negotiated the transition from an agrarian to an industrial society. Drawing on Mexican community studies, gender studies, and rural studies, these essays overturn the stereotypes of Mexican peasant women by exploring the complexity of their lives and roles and examining how these have changed over time. The book emphasizes the active roles of women in the periods of civil war, 1854-76, and the commercialization of agriculture, 1880-1910. It highlights their vigorous responses to the violence of revolution, their increased mobility, and their interaction with state reforms in the period from 1910 to 1940. The final essays focus on changing gender relations in the countryside under the impact of rapid urbanization and industrialization since 1940. Because histories of Latin American women have heretofore neglected rural areas, this volume will serve as a touchstone for all who would better understand women's lives in a region of increasing international economic importance. Women of the Mexican Countryside demonstrates that, contrary to the peasant stereotype, these women have accepted complex roles to meet constantly changing situations. The authors contend that New Spain was neither feudal nor pre-capitalists as some Neo-Marxist authors have argued. Instead they advance two central themes: that only in New Spain did a true mestizo society emerge, integrating Indians, Europeans, Africans, and Asians into a unique cultural mix; and that colonial Mexico forged a complex, balanced, and integrated economy that transformed the area into the most important and dynamic part of the Spanish empire. The revisionist view is based on a careful examination of all the recent research done on colonial Mexican history. The study begins with a discussion of the area's rich pre-Columbian heritage. It traces the merging of two great cultural traditions—the Meso-american and the European—which occurred as a consequence of the Spanish conquest. The authors analyze the evolution of a new mestizo society through an examination of the colony's institutions, economy, and social organization. The role of women and of the family receive particular attention because they were critical to the development of colonial Mexico. The work concludes with an analysis of the 18th century reforms and the process of independence which ended the history of the most successful colony in the Western hemisphere. The role of silver mining emerges as a major factor of Mexico's great socio-economic achievement. The rich silver mines served as an engine of economic growth that stimulated agricultural expansion, pastoral activities, commerce, and manufacturing. The destruction of the silver mines during the wars of Independence was perhaps the most important factor in Mexico's prolonged 19th century economic decline. Without the great wealth from silver mining, economic recovery proved extremely difficult in the post-independence period. These reverses at the end of the colonial epoch are important in understanding why Mexicans came to view the era as a "burden" to be overcome rather than as a formative period upon which to build a new nation.
